이 논문은 전후 일본의 외국인에 대한 국적처리문제를 다뤘다. 여기서 말하는 외국인이란 주로 재일한국인(조선인·민단·조총련)을 지칭한다. 전후 일본에 거주했던 외국인의 국적처리는 영국이나 프랑스의 舊식민지인에 대한 국적처리 관례에 따른 것이 아니고 일방적으로 일본 국내법을 적용했음을 알 수 있다. 이는 많은 재일한국인들이 불안정한 신분으로 일본에 정주하게 되었으며 일본사회가 이들에 대한 차별의 원인이 되기도 했다. 이후 1990년대를 기점으로 재일정주외국인중 재일한국인비율이 과반수이하로 줄었고 동시에 일본정부의 정주외국인 정책도 완화되어가는 현상이었다. 이후 이러한 현상은 불안정한 재류형태에도 불구하고 재일한국인에 대한 처우는 개선되는 듯 했다. 하지만 재일한국인의 일본체류가 이전보다는 나아졌다고 하지만 문제는 재일한국인의 숫자가 해마다 급속히 감소하고 있다는 데 있다. 이는 일본사회의 인구고령화·少子化로 인한 인구감소에 고심하던 일본정부가 정주외국인에 대한 일본사회 구성원자격요건을 강화하려는 움직임을 보이고 있기 때문이다. 일본정부의 이런 움직임은 기존의 정주외국인이 住民으로서 일본사회의 보호를 받을 수 있었지만 이제는 國民이 아니면 사회의 보호대상에서 제외시키는 국적법과 호적관련 법안의 추진강화를 보이고 있기 때문이다. 그래서 이 논문은 재일한국인의 정주외국인으로서의 일본체류의 한계와 재일한국인의 감소로 인한 문제점 그리고 대응을 살펴보기로 한다.
Abstract
Focus on the Japanese Korean Minority Policy Since World War Two This paper analyzes the Japanese minority policy since World War Two. The minority in this paper specificly means the Korean minority in Japan(Korean who is pro-south government and pro-north government). Since World War Two, the Japanese minority policy was framed in a domestic manner unlike Britain or France policies that were framed by experiences. It’s because most of the Korean minorities in Japan stayed with instability and discrimination. Since the 1990s the Korean minority shared less than 50 percent among the minorities in Japan, and at the same time the Japanese minority policy started an appeasement policy. Instability is still remaining, but the social status of Korean minorities seems to be better than before. However, a big problem is the decrease in the Korean minority every year. There are two reasons. First, since the 1990s less children were born and the aged society in Japan was a big problem. Second, the Japanese government announced a new law called the ‘Japanese Care Law’. This law could only cover the Japanese nationality when an emergency occurred. But the new law, ‘Local People Care Law’ is totally different from the previous law. It controls all the people in Japan, even those who don’t have the Japanese nationality. This paper showed the instability of the Korean minority in Japan and the solutions to the decreasing Korean minorities.
