Abstract
EU DSM Copyright Directive article 15 shall provide protection of press publications concerning online uses. Under the DSM Copyright Directive, the publishers shall be entitled to receive a appropriate share of the revenues that press publishers receive for the use of their publications by information society service providers. In Fact, the protection of press publications concerning online uses under DSM Directive is related to the so-called “ancillary right”, which is already enacted in Germany and Spain. However, several studies on the impact of legislation on Germany and Spain ancillary right on news publishers have revealed that adverse side-effect result in number of negative consequences. In addition, the legislation of Germany and Spain, which granted the exclusive right of so-called ancillary right seems to have failed to achieve the objective of publishers receiving certain compensation. However, the DSM Directive, which will be imple- mented across whole states of the European Union (Expect for the United Kingdom), is likely to produce results different from the ancillary rights limited to the two countries. The results of empirical studies are likely to be a consideration for the European Union member states in determining the strategy they will take in relation to the rights granted to publishers by DSM directive. This article aims to analyze Article 15 of the DSM Directive on the Protection of Press Publications Concerning Online Uses, to examine in detail the situation in Germany and Spain, which had been legislating similar to the DSM Directive, and to analyze the issues involved.
