본 연구는 WTO/TBT협정에서 다루고 있는 핵심적 논의주제인 기술규정 (technical regulations), 표준 (standards) 및 적합성평가절차 (procedures for assessment of conformity)의 국가간 조화를 위해 반드시 고려되어야 하는 국가측정표준의 상호인정에 관한 NMI의 활동을 고찰함으로써 TBT협정의 원활한 이행을 위한 정책적 방안을 제시하는 것을 목적으로 하였다. 본 연구의 결과가 WTO체제 아래 전 세계적으로 진행되고 있는 자유무역 추세에 대응하기 위한 우리 정부의 노력에 기여할 수 있는 정책적인 시사점은 다음과 같다. 첫째, TBT협정에 대하여 정부내 각 부처의 이해와 관심이 필요하다는 사실이다. 둘째, 산업현장에서 수행하고 있는 시험, 검사, 교정 등과 같은 적합성평가절차가 국가측정표준에 대한 소급성을 확보하여야 비로써 국제적인 신뢰성을 확보할 수 있다는 사실을 인식해야 한다는 것이다. 마지막으로 WTO 출범 후 전 산업분야에서 요구되는 자유무역의 경향과 함께 이러한 추세를 반영하는 무역 및 산업 환경의 변화에 적절히 대처하기 위해서는 국가표준기관의 연구영역과 활동범위를 대폭 확대하기 위한 정부차원의 인적, 물적 지원과 국가기반의 확보를 위한 노력이 필요하다는 점이다.
Abstract
The purpose of this study is to review what institutional approaches can be considered to facilitate the implementation of the WTO/TBT Agreement, especially in metrological aspect based on the CIPM MRA and its core operators - NMIs. Following the analysis of both the WTO/TBT Agreement and CIPM MRA, three suggestions were made as institutional approaches. Firstly it is to amend some WTO/TBT Agreement regulations which will allow metrology to serve as an apparent actor to implement the WTO/TBT Agreement. In terms of the fact that metrology provides a scientific basis for the three key factors of technical regulations, standards and conformity assessment procedures in the WTO/TBT Agreement, the amendments or supplementary clause to certain related regulations are desirable. The second is to explore any possibility for the NMI experts to necessarily join the 'Technical Experts Groups' being established to assist the panel in settling a dispute of a technical nature. As the last methodology, it was suggested for the CIPM members to participate in the WTO Committee on Technical Barriers to Trade. This will help to link the efforts of international metrological communities with those of WTO to reduce the technical barriers to trade. Last but not least, NMIs themselves should seek ways to cope appropriately with the challenges out of the globalization of trade and meet the needs of industries accordingly. Such ways must include even the change of the NMIs' long-standing functionalities. Because today, reliable measurements are required not only in the manufacturing sector and domains of national and international trade, but also in the areas of human health and safety, protection of the environment, communications, and in all fields of science and engineering.
