Abstract

In the proceeding of divorce, the traditional method of property division is not workable for assigning a compnainon animal between divorce parties. In general, the main purpose of the property division in divorce is to fairly distribute the actual marital assets acquired during marriage to each divorced party. And this distribution is possible when the share to be distributed to each person is determined through an objective valuation of the property. However, unlike ordinary properties, companion animals form emotional bonds through mutual interaction with people. Since these extremely subjective values are not monetizable by uniform standards, it is difficult for companion animas to be subject to the existing property division law. In addition, in that the ultimate purpose of the parties in so-called “companion animal custody” litigation is to maintain an emotional relationship with the companion animal, not to compensate them financially as much as the value they place on the companion animal, the existing property division method has limitations. Above all, the existing property division law does not guarantee the welfare of the animal, such as the safety and protection of companion animals after the division of property. That is, the final determination of ownership or custody of a companion animal does not reflect the characteristics of companion animals as living beings. And it does not accord with the purpose of the Animal Protection Act, which our legal system has prepared to protect the life of animals, ensure safety and promote welfare. In this regard, as far as assigning ownership or custody of companion animals in divorce proceedings is concerned, the traditional property division law needs to be modified to reflect the characteristics of companion animals. It requires a new standard for distribution of a companion animal that can ensure the safety and protection of the companion animal and the maintenance of emotional bonds with people. For example, it needs to be consider the specific details of the companion animal and the companion situation in the past, the financial condition, residential environment, life pattern of each divorced party, etc.
