Abstract
The neo-institutional approach to economic development and economic takeoff surrounding the Industrial Revolution presents a valid alternative for explaining South Korea’s exceptional entry into the ranks of advanced nations. This paper examines the transformation process of modern property rights systems, beginning with the birthplace of the Industrial Revolution, the United Kingdom. It also explores how Germany’s independent development of a real estate registration system, which was later introduced to Korea via Japan, contributed to institutional economic growth. The institution that played a pivotal role in the British Industrial Revolution was not so much the security of property rights, as argued by early neo-institutionalists, but rather a series of modernization processes that liberated property rights from medieval communal constraints, enabling free transactions and secured lending in the market. In this process, the system of land expropriation for public interest was established, which, to some extent, led to a retreat in property rights security. The most efficient legal system in the modernization of property rights was the public registration system for real estate, namely the land registration system. Due to its centuries-old tradition of mortgage registration, Germany, a civil law country, was able to establish a much faster and more efficient real estate registration system than the common law-based United Kingdom. The German legal system was transmitted to Korea through Japan, facilitating the unprecedentedly rapid introduction and establishment of a modern property rights system. This institutional foundation has supported Korea’s rapid economic growth and economic takeoff over the past century.
