우리나라의 근대적 지적제도와 등기제도는 일본이 메이지유신 이후 서양의 등기법과 군사 목적의 지적측량 기술을 발전시켜 1910년 일제강점기 조선 토지조사사업을 시행하고자 일본 국내보다 더 발전된 근대 독일식 부동산공시제도를 이식한 것에서 시작된다. 현재 운용되고 있는 이원적 부동산공시제도는 그동안 국민의 불편과 재정 낭비를 초래한다는 문제 지적과 함께 민원 업무의 통합과 현대식으로 일원화할 필요성이 계속 제기되고 있다. 부동산공시제도의 연혁적 기원, 우리 나라에의 도입과정과 배경을 살피는 연구이다. 동·서양 공시제도의 융합과정을 살핌으로써 등기부에 토지대장의 기능 부여, 국가배상 및 실질적 심사권 등의 보완 후 등기공신력 인정으로 나아가는 기초로 삼고자 한다. 또한 우리나라의 미래지향적 관점에서 지방분권 시대에 부응하여, 등기직 공무원을 지방직으로 전환하여 전문성과 신뢰를 확보할 수 있는 부동산공시제도의 통합으로 이어지길 기대한다.
Abstract
As Korea’s land system, the modern cadastral system and registration system were started by Japan in 1910 by transplanting German style modern real estate public disclosure system which was more developed than Japan domestic system to carry out Chosun land survey project during the Japanese colonial period with the Western registration law and cadastral surveying technology for military purposes which were developed after the Meiji Restoration. The dualistic real estate public disclosure system currently in operation has been pointed out the problem of causing inconvenience to the public and waste of finances, and the need to integrate civil affairs and unify them in a modern way continues to be raised. However, there is still lack of academic research to clarify the process and background of how the real estate public disclosure system, which has unclear origin in the West, was introduced to Korea through Japan. Therefore, this study considers the convergence process of the Eastern and Western public disclosure systems, claimed that recognition of the public confidence in the registration was necessary after supplementing the function of the land register, the state compensation system, and the right to actual examination in the register and responding to the era of decentralization from a future-oriented perspective in Korea, suggested the need for integration plan of real estate public disclosure system that can secure expertise and trust by converting public officials at courthouse who is taking charge of registration system to local government officials.
