In the case of a lawyer acting as a mediator, a lawyer-mediator have to comply with the confidentiality under the mediation rules and may be obligated to report any professional malpractice related thereto according to the lawyer’s Professional Responsibility. If the attorney's duty to report is prioritized by emphasizing the ethics of the attorney, the confidentiality of the mediaton may be destroyed. Lawyers' ethic code in Germany and some states in the United States do not reflect the difference between mediation and trial and stipulate that lawyer ethics are fully applied to lawyers and mediators. But It is necessary to adjust the application of the professional duties of lawyers so that confidentiality in mediation can be properly ensured.
