Abstract
Parliamentary sovereignty was regarded as ultimate constitutional principle in the United Kingdom (“UK”). However, with the enactment of the Human Rights Act 1998, courts are able to make a declaration of incompatibility when legislation enacted by the parliament is incompatible with the rights stipulated in the European Convention for the Protection of Human Rights and Fundamental Freedoms (“ECHR”). Consequently, courts are empowered to exercise judicial review over the parliament’s legislation. This is one of the most revolutionary changes in the UK’s constitutional history. This article can be divided into three parts. First, it examines the background of the Human Rights Act, as well as its main content and defining characteristics. Second, it analyzes the aspects of judicial review through key British court judgments, in which declarations of incompatibility have been made. Third, it explores noteworthy constitutional meanings and implications of the UK’s judicial review system. The UK had not enacted any legislation incorporating the ECHR into its domestic law for many years. In light of the rising number of cases the UK lost in the European Court of Human Rights, however, the demand for such a legislative measure increased. During the May 1997 election campaign, Labour Party pledged to incorporate the ECHR into British domestic law. They obtained a resounding victory that year, which led to the passing of the Human Rights Act on November 9, 1998. As the first written Bill of Rights since 1689, the Human Rights Act significantly change the overall legal system in the UK. Under Article 3 thereof, courts are obliged to interpret and implement all legislation in a way that is compatible with the rights stipulated in the ECHR “so far as it is possible to do so.” According to Article 4 thereof, a court may make a declaration of incompatibility if such an interpretation is impossible. However, even if a court makes a declaration of incompatibility, the legislation in question does not become immediately invalid, and it is still left to the discretion of the parliament to rectify the situation. This is a unique approach, different from that taken by a more widespread model of judicial review in which statutes lose their effect upon being ruled unconstitutional. It can be said that the UK acknowledges judicial review while seeking harmony with the traditional conception of parliamentary sovereignty. Since the Human Rights Act came into force, most of the declarations of incompatibility have been made in relation to Article 5 (Right to liberty and security), Article 6 (Right to a fair trial), Article 8 (Right to respect for private and family life), and Article 14 (Prohibition of discrimination) of the ECHR. It is rare for a declaration of incompatibility to be made, but when it happens, the parliament in many cases accepts it and enacts new legislation, despite having no legal obligation to respond it. Under the Korean system, the retreat of democracy is attributed to the power granted to the judiciary, the unelected branch, to make major decisions on behalf of the community by invalidating unconstitutional laws. In the UK, even if a court declares legislation incompatible, the parliament still has the final say. The UK’s judicial review system can leave critical social issues for legislative and public debate and enhance the quality of constitutional analysis through a dialogue between the parliament and courts. The UK’s attempt to promote harmony with the traditional conception of parliamentary sovereignty while introducing a judicial review system, also provides meaningful implications for the direction of our constitutional review system.
