독일의 직접민주주의: 자치분권국가에서 시민입법과 주민투표의 현황을 중심으로

초록

이 논문은 시민자치를 담아내는 직접민주주의에 관한 것이며, 시민입법과 주민투표가 시민자치를 실현하는 주요한 정치제도라는 입장에서 출발한다. 독일이 지역적 연구사례이다. 독일의 직접민주주의의 현황을 살펴보며 시민입법과 주민투표와 관련하여 제도와 쟁점이 되는 사안을 검토한다. 나아가 독일의 사례가 우리나라의 정치제도에 줄 수 있는 함의도 성찰한다. 독일을 지역적 연구사례로 선택한 것은 비교와 성찰의 차원에서 독일의 지방자치와 직접민주주의가 우리의 것보다 완숙한 경지에서 운영되고 있기 때문이다. 독일의 민주주의는 1950년대 이후 실시된 체계적인 정치교육과 더불어 자기가 사는 자치단체의 사안에 대한 시민의 참여로 발전했다고 볼 수 있다. 독일은 연방 수준에서는 대의민주주의를 하면서도 주와 자치단체 수준에서는 직접민주주의를 시행하고 있다. 독일 시민은 주의 시민입법과 자치단체의 주민요구 ․ 주민결정의 절차를 경험하면서 시민의 자유를 느끼고 자유를 실현시켰다. 그러한 경험에 기초하여 연방 차원에서 일을 잘 할 수 있는 국회의원을 선출할 수 있었다. 독일 모델이 한국에 주는 가장 큰 함의는 바로 이 지점에서 찾아진다. 스위스처럼 국가 전체 차원에서 직접민주주의를 실시하는 것은 어렵겠지만 지방자치단체에서만큼은 독일처럼 직접민주주의가 활발히 시행될 수 있도록 하여 지방분권 ․ 지방자치를 실현하고 시민덕성이 향상될 수 있는 기회를 제공해야 한다. 시민덕성이 향상되면 자연스럽게 국가 전체 수준을 잘 이끄는 능력 있는 정치인을 선출할 수 있다. 우리의 헌법에는 지방자치, 지방분권, 직접민주주의에 대한 규정이 빈약하다

Abstract

This article is about the direct-democracy which promotes civil autonomy. It takes a stand on that local referendum(Bürgerbegehren/Bürgerentscheid) and citizen-legislation(Volksgesetzgebung) are the key institution realizing the civil autonomy. Germany is the case to study. First of all the current situation of Germany’s direct democracy is searched. Next to that the institution and issues related with citizen legislation and local referendum are discussed. Finally, it will be reflected what german case implies to korean political system. The reason that german case is chosen lies in that german direct-democracy is a good model to compare with korean case. German Democracy has been developed not only by the political education introduced since 1950 but also by participation of german citizen in the issues(Sachfragen) of town/city(Gemeinde). Actually Germany has the representative system of federal politics but at the same time it has practiced direct-democracy in the level of state(Land) and local Gemeinde. German citizen could have realized the freedom while they have taken part in the process of referendum and resident’s voting in Land and Gemeinde. On the basis of these political experiences in the local level they could have elected the good parliament’ members in the federal level. That is the most important implication of german model to korea. It is difficult that the total direct-democracy is introduced such as in swiss, but it is possible in korea that the direct-democracy is practiced actively in the level of the self-governing bodies. The active practice of direct-democracy might give the chance to progress of civic virtues which would lead us to elect the good politicians in the national level. Korean constitution has poor rules of local self-government,decentralization of power, and direct-democracy.
