Abstract
China and Taiwan were excluded from the new membership of CPTPP, and only the UK was approved, so it is necessary to establish a specific response strategy for our trade policy in the future. Although China and Taiwan have also made considerable efforts to join CPTPP, member states oppose China's accession to maintain strict CPTPP standards during the negotiation process. The reason is that Australia and Canada, major members of the CPTPP, do not allow China, which is at odds in economic and security relations. In particular, China, a socialist market economy, expects that it will be difficult to accept CPTPP's strict conditions through market opening in areas such as e-commerce, intellectual property rights, and technology transfer. Therefore, this article focused on the impact of the UK's new membership in CPTPP on Korea's trade policy in the future. The economic impact of new membership by country may vary, but the phenomena that can be assumed by Korea joining CPTPP in the future are as follows. First, unless a system is established to objectively prove the procedural obligations of CPTPP regulations and immediately and quickly take countermeasures, Korea's new membership may have a negative effect. Therefore, detailed measures should be prepared on how to use the CPTPP agreement after new membership. In particular, in areas where evidence is required to prepare for the country of origin investigation, etc., thorough preparation should be made even before joining. In a situation where trade friction with the trading partner is likely to occur, scientific entry obligations should be strengthened and information provision obligations should be observed in order to resolve trade disputes with the parties as soon as possible. Second, multilateral negotiations on e-commerce and digital trade have been underway since the new coronavirus in 2019, and it will be required that CPTPP's multilateral international rules on data transfer promote free data transfer and digital competition while not hindering regulations on Internet and data distribution. In addition, it is necessary to consider and regulate the consistent aspects to the extent permitted by each country in order to match the overseas transfer and localization measures of data and engage in international norms of digital trade. Third, CPTPP is preparing a countermeasure for equalization of international rules. Member States are required to comply with the principles of international model law in the legal framework on digital trade and e-commerce, while also trying to adopt a multi-stakeholder model that promotes the contribution of various stakeholders. The private sector plays a central role in securing openness and cybersecurity in international data distribution, especially in the field of cybersecurity, as various methods, including self-regulation approaches, are being discussed rather than forced by the government.
