국가첨단전략기술이나 핵심기술은 국가의 안보나 국민경제에 막대한 영향을 미칠 수 있으므로 이에 대한 법적·정책적 구제 및 보호조치를 엄격하고 철저하게 마련하여야 할 것이다. 따라서 본 논문에서는 산업기술의 유출에 관한 문제를 체계적으로 해결하기 위하여 다음과 같은 대응방안을 제시하였다. 첫째, 산업기술체계에 관한 통일적 규율이 필요하다. 입법체계 간의 불균형적인 부분을 정합적으로 검토함으로써 제도의 실효성을 향상할 필요가 있고, 이에 주관기관도 통일되어야 할 필요가 있다. 둘째, 양형기준의 향상과 전문재판부의 도입을 검토할 필요가 있다. 재판실무에서는 막대한 재산상 피해를 야기하는 산업기술과 영업비밀의 유출이라고 하더라도 이를 경미하게 처벌하고 있다. 또한 재판관별로 재량의 여지가 넓은 편이기 때문에 전문재판부에 의한 엄격한 재판을 실시하여 핵심기술의 유출을 예방하고, 재발 가능성을 급격히 낮출 필요가 있다. 셋째, 민사적 구제절차의 범위를 확대할 필요가 있다. 따라서 민사상의 압류제도를 허용하는 명시적인 근거규정을 마련하고, 민사적 압류제도를 원활하게 운영하여야 한다. 위반행위에 대한 징벌적 손해배상의 범위도 확대되어야 하고, 기술유출에 따른 정부의 즉각적인 협조를 통하여 국제분쟁절차를 신속하게 진행하여야 할 것이다.
Abstract
Since national advanced strategic technologies or core technologies could have a huge impact on national security or the national economy, legal and policy relief and protection measures should be strictly and thoroughly prepared. Therefore, in this article, the following countermeasures were proposed to systematically solve the problem of the leakage of industrial technology. First, there is a need for unified discipline for the industrial technology system. It is necessary to improve the effectiveness of the system by consistently reviewing the imbalances between the legislative systems, and accordingly, the competent authority needs to be unified. Second, it is necessary to consider improving the sentencing standards and introducing a specialized court. In trial practice, even if it is the leakage of industrial technology and trade secrets that cause enormous property damage, it is lightly punished. In addition, since there is a wide range of discretion for each judge, it is necessary to conduct strict trials by the specialized court to prevent the leakage of core technologies and to drastically reduce the possibility of recurrence. Third, it is necessary to expand the scope of civil relief procedures. Therefore, explicit ground rules for allowing the civil seizure system should be prepared and the civil seizure system should be operated smoothly. The scope of punitive damages for violations should also be expanded, and international dispute procedures should be carried out quickly through immediate cooperation from the government following technology leakage.
