초록

India has emphasized the ‘Digital India’ goal as one of the national industry goals while India has become the hosting state of the G-20 summit. India has suffered from its weak second industry (commodities trade industry), which was relatively not strong enough compared to other states. As a result, its judiciary has suffered from a huge number of pending cases in the jurisdiction. India must adopt and transfer into the digitalized process. During the last decade, India did not reconsider strengthening its methods of dispute resolution, which become important in digital trade while digital trade has rapidly increased, This paper reviews the causation of legal disputes caused by digital trade in India and the possibility of legal dispute resolution. The legal dispute caused by digital trade might deviate from the traditional legal frame and could be currently governed by separate regulations. There are two different international business transaction and domestic laws. Then, it might cause further confusion due to difficulties in the application of multiple forms of separate regulations. Therefore, it might cause negative effects on digital trade. This paper is to review separate regulations of digital dispute resolutions and the necessity of unifying these to improve India’s digital trade policy.

Abstract

India has emphasized the ‘Digital India’ goal as one of the national industry goals while India has become the hosting state of the G-20 summit.
