본 연구는 미국 반덤핑 제도에서 수출가격과 정상가격 간의 공정한 비교를 통해 산정되는 덤핑마진 결정 과정에 있어, 생산원가 산정의 핵심 요소인 G&A Ratio(General and Administrative Expenses Ratio)의 정의 및 산정 방식에 내재된 구조적 문제를 분석한다. WTO 반덤핑협정 및 미국 관세법에 따라 정상가격은 수출국 내수시장에서의 정상적인 거래를 기준으로 하며, 미국 상무부는 원가 미만 판매 테스트(Cost of Production Test)를 통해 이를 판단한다. 이 과정에서 G&A Ratio는 제조원가에 가산되어 생산원가를 구성하게 되며, 이는 덤핑마진 산정에 중대한 영향을 미친다. 그러나 현행 제도 하에서는 G&A Ratio의 산정 기준이 명확히 법제화되어 있지 않고, 행정당국의 자의적 판단과 관행에 따라 결정되고 있어 공정성 및 객관성의 문제가 제기되고 있다. 본 논문은 G&A Ratio 산정과 관련된 비경상적 비용의 포함, 제조원가와의 산정범위 불일치, 조사대상기간과 회계연도 간의 시간적 불일치 문제를 중심으로 현행 제도의 한계를 분석하고, 보다 정교하고 합리적인 생산원가 산정 기준 마련의 필요성을 제시한다.
Abstract
This study examines the structural issues embedded in the definition and calculation methodology of the General and Administrative Expenses Ratio (G&A Ratio), a critical component in determining the cost of production used for calculating dumping margins in U.S. anti-dumping investigations. Under the WTO Anti-Dumping Agreement and U.S. trade law, a fair comparison between export price and normal value is required, and the Department of Commerce conducts a Cost of Production (COP) Test to determine whether domestic sales were made in the ordinary course of trade. The G&A Ratio is added to the cost of manufacturing to derive the full cost of production, directly influencing the magnitude of dumping margins. However, the current system lacks clear statutory standards for calculating the G&A Ratio, relying instead on administrative discretion and past practice. This paper identifies key fairness concerns in the current system, including the inclusion of non-recurring expenses, the mismatch between cost allocation scopes, and temporal inconsistencies between the period of investigation and financial data used. The study concludes by emphasizing the need for more consistent, transparent, and product-specific cost standards to ensure fairness and accuracy in the determination of dumping margins.
