유엔 정례인권검토제도(UPR)와 형사사법개혁의 인권지향적 체계화

현 정부와 시민사회의 주요 현안인 형사사법개혁은 인권보장 강화가 목표다. 유엔 정례인권검토제도(UPR)하에서 국가보고서 제출을 위한 인권상황점검 과정과 국제사회 차원의 검토ㆍ권고 절차는 형사사법개혁을 인권증진 원칙하에 체계적으로 추진하는데 중요 기반이 될 수 있다. 본 논문은 유엔의 정기적 국가별 인권검토제도를 형사사법체계의 인권보장기능 증진을 위한 개혁정책을 체계화하는데 활용하는 방안 제안이 목적이다. 국가별 정례인권검토제도는 정기적으로 검토심의가 연속됨으로써 각국의 인권증진 정책에 연속성과 체계성을 줄 수 있다. 국가인권현실과 정책실현이 객관적 관점에서 검증평가 받는다는 점에서 해당 국가인권정책의 정당성과 효과성 또한 보장받을 수 있다. 정부와 시민사회를 인권상황 점검과 후속개선노력에 있어서 건설적 협력관계로 묶어 줌으로써 사회전반 인권역량을 강화할 수 있다. 특히 정례인권검토에서 지적되는 인권침해문제와 개선권고내용의 상당부분은 형사사법기관의 인권침해방지와 인권옹호기능 강화와 관련된다. 인권문제의 개선노력을 검증하고, 인권보장 개선조치를 권고함에 있어서 정부보고서와 유엔보고서 내용의 상당부분이 형사법 개정 및 형사정책 방안인 이유다. 이는 유엔의 정례인권검토제도가 국가인권정책기본계획과 국정목표와 함께 형사사법 개혁이 인권원칙을 견지하고 흔들림없이 지속적으로 추진되도록 인도하는 틀이 됨을 의미한다. 즉 형사사법개혁이 정치적 이해와 단기적 성과에 흔들리지 아니하고, 인권보장원칙을 중심으로 체계화될 수 있다.
Abstract
This essay aims to propose systematization of criminal justice reform, based on the mechanism of UN Universal Periodic Review(UPR). Korea is preparing its third UPR in the year of 2017. Korean new administration placed human rights protection a centre piece of its criminal justice reform policy, which aims to promote democratic principles and human rights protection for the criminal justice agencies. Since the second UPR in 2012, government ministries have made efforts to incorporate the UPR recommendations into specific policy tasks, and reflected the result in the National Action Plan for Human Rights. Korean national report for the third UPR has just been drafted by the Ministry of Justice through consultation and cooperation with all relevant government ministries and agencies. In the process of drafting the national report, the Ministry held a public consultation with civil society groups along with relevant ministries, the National Human Rights Commission. The Government intends to take the proposals for policy changes from the civil society into consideration during the process of policy making and implementation. Such domestic procedure, not to mention the international process of the UPR, will systematize successive criminal justice reform for the promotion of human rights principles, with the scheme of National Human Rights Action Plan; Such system secures principles and values in the reforms of criminal laws and criminal justice agencies from any political distortion or disruption. This article proposes the systematization of human rights-oriented criminal justice reform, which means the reform must be based on international human rights standards, and be built on the cooperative mechanism of the UPR and National Human Rights Action Plan.
