미국의 공증인 선발 및 양성 제도 연구

초록

미국의 공증인은 크게 두 가지로 나눌 수 있다. 하나는 영국의 보통법에서유래하나 미국에 독특한 형태의 공증인으로서, 이 공증인은 의뢰인으로부터선서를 받거나 의뢰인이 서류에 기재한 서명이 의뢰인의 것이 맞다는 것을 확인하고 그에 관한 증명서를 발급하는 것을 주요 임무로 하며 대다수의 주(州)에서공증인(notary public)이라고 하면 이들을 의미한다. 다른 하나는 대륙법계(라틴계)의 공증인으로서 대륙법계의 전통을 가진 루이지애나주와 푸에르토리코자치주의 공증인과 기존의 보통법계 공증인의 단점을보완하기 위해 앨라배마주와 플로리다주에서 도입한 대륙법공증인(civil-law notary)이다. 이들은 법률문서를 작성하거나, 타인이 작성한 문서에 내용의 진정성이나 신빙성, 법적 효력을 부여할 권한이 있다. 미국의 대다수 주(州)에서는 공증인이 되기 위해 특별한 자격이 필요 없으며,교육을 이수하거나 시험을 통과할 필요도 없이 일정 금액의 보증금을 납부하는 등간단한 절차에 의해 공증인이 될 수 있다. 그러나, 대륙법계 공증인의 경우 루이지애나주를 제외한 나머지 주(州)에서는 변호사의 자격이 있을 것을 요건으로 하는등 보다 엄격한 자격요건을 두고 있다. 공증인에 대한 교육은 대다수의 주(州)에서는 임의사항이며 소수의 주(州)에서만필수교육 제도를 두고 있다. 그러한 교육은 주(州)에서 운영하는 교육기관 또는주(州)에서 승인한 사설 교육기관에서 시행하고 있다. 이와 같은 미국 대다수의 공증인은 자격요건이 낮고, 교육이 미흡하여 그 자질이매우 저하되었다는 비판을 받고 있으며, 이에 대한 여러 대응책이 마련되고 있다. 그러나 많은 법률문서들이 법률의 규정에 의하여 혹은 관행적으로 공증을 거치고 있고, 그로 인해 사기나 문서위조 등이 예방되는 효과가 있는 것으로 인정되고 있는 바, 사기나 문서위조의 범죄율이 높은 우리나라에서도 미국의 공증인과같이 보다 간편한 절차를 거쳐 많은 법률문서들에 대한 증인의 역할을 할 수 있는 제3의 공증제도를 모색할 필요가 있다.
