조건부 구속제도 도입은 불구속 수사의 원칙 등을 근거로 20여년 간 계속 주장되었다. 그러나위 제도는 수사 단계의 인신구속제도에 중대한 변화를 일으키므로 실제 수사와 공판을 담당하는실무자의 관점에서 제도 도입의 필요여부, 도입시의 실무적·법리적 문제점에 대하여 면밀하게 고찰할필요가 있다. 조건부 구속제도 도입론이 계속 전개되던 지난 26년 간 구속인원은 72% 급감하였고, 구속 전피의자심문의 실질화와 불구속 수사와 재판의 원칙이 상당 부분 정착되었다. 현재도 구속적부심신청시 판사의 직권으로 기소 전 보석이 가능하며, 다양한 사법통제·석방 제도가 있다. 조건부 구속의성패는 ‘준수사항 위반 여부에 대한 추적과 위반시 신속한 조치’에 달려 있으므로 이에 대한 보완과, 검사의 청구권 부여와 준수사항 위반자에 대한 과태료나 감치의 적정성 등 법리적 문제점에 대한충분한 검토가 필요하며, 실무상 준비되지 않는 성급한 제도 도입에는 신중할 필요가 있다.
Abstract
The introduction of a conditional detention system, underpinned by the principle of investigation without detention, has been a subject of continuous discussion for over two decades. Given that such a system would substantially alter the use of physical restraint during investigations, a meticulous examination of its necessity, along with potential practical and legal challenges, is imperative from the viewpoint of practitioners engaged in investigations and trials. Notably, over the last 26 years of ongoing debate regarding conditional detention, there has been a 72% reduction in detention, and the principles of substantive pre detention hearings and the preference for non-custodial investigations and trials have become largely consolidated. Presently, pre-indictment bail can be granted upon a request for review of confinement legality, and diverse judicial oversight and release mechanisms currently exist. The efficacy of conditional detention hinges on robust mechanisms for monitoring compliance with its conditions and for prompt intervention in instances of violation; therefore, further development in these areas is crucial. Moreover, a comprehensive assessment of legal considerations, including the scope of prosecutorial authority to petition for enforcement and the suitability of penalties such as fines or confinement for non-compliance, is essential.
