Abstract

The EU has been an early advocate for the development and provision of services within the internal market, looking for ways to encourage the immediate use of assets provided by the sharing economy. While a wide range of sharing economy services are offered and used in the EU, including home sharing, car travel, and domestic services, tensions between new service providers and existing market operators are recognized as a key challenge to the harmonious development of the sharing economy in the internal market. Recently, the European Commission published a draft EU Short-Term Accommodation Rental Services Data Regulation, which establishes uniform standards for the collection and sharing of data related to short-term accommodation rental services. The purpose of the proposed rules is to ensure that reliable data is available to enable informed, appropriate and proportionate policy-making on short-term accommodation rental services. In Korea, there is still no clear system or policy to promote the sharing economy, and there are many difficulties in reconciling the conflicting interests of existing market operators. In addition, regulatory discussions on online platforms are limited to a few laws. Therefore, it makes sense to look at legislative developments in the EU, which has already put in place various regulatory tools aimed at realizing the Digital Single Market. In particular, the Draft Regulation sets out the registration process for short-term accommodation rental service providers and the obligations and technical elements of online short-term rental platforms, which will provide many legal and technical references for our legal system in the future.
