Abstract

In consumer contracts, information asymmetry arising from the structural characteristics of consumers’ legal position is widely recognized as a factor that impairs rational decision-making and undermines contractual fairness. To address this issue, modern consumer contract law imposes a duty to provide information on businesses. In particular, Article 4 of the Act on Fair Labeling and Advertising mandates the inclusion of material information in labeling and advertising as specified by the Korea Fair Trade Commission (KFTC), thereby codifying the business’s information duty in a specific and statutory manner. However, interpretive challenges arise from the interaction between Article 3 and Article 4, as violations frequently involve elements of both provisions. This paper argues that, depending on the nature and category of the conduct, a violation of Article 4 may not only result in administrative fines but may also qualify as deceptive labeling or advertising under Article 3(1), thereby triggering strict liability under Article 10. To support this claim, the paper classifies and analyzes different types of violations, examining how each may lead to distinct legal consequences. Furthermore, under the current guidelines of the Act on Fair Labeling and Advertising, any omission of material information—regardless of whether it is intentional or not—is uniformly interpreted as deceptive labeling or advertising. This mechanical approach results in the imposition of strict liability even for non-intentional omissions, leading to an undue burden on businesses. Accordingly, this paper argues that Article 3 should be excluded specifically in cases where the omission of material information was not intentional. In such cases, liability should be assessed under the fault-based framework of Article 750 of the Civil Act. By refining the criteria for legal responsibility in this context, the paper seeks to establish a more balanced framework between consumer protection and business accountability, while also enhancing predictability and doctrinal coherence in the application of the law.
