문화정책상 규제와 국제투자보호의 관계에 관한 연구 - 문화 발전을 위한 공익 규제와 재산권 침해의 균형을 중심으로 -

문화의 발전은 곧 문화산업의 발전을 의미한다. 이러한 문화산업은 문화적 가치와 경제적 가치를 모두 내포하는 양면성을 띠고 있다. 문화가 곧 국력이 되는 지금 시대에서 문화가 발전하려면 투자가 필요한 것은 당연하다. 이러한 투자를 활성화하기 위해 국가 간 투자보호협정을 체결하여 상대국으로부터 외국 투자에 대해 서로 법적 보호를 해주는 구조가 급속히 발달하고 있다. 하지만 투자 유치국의 주권적 규제 권한을 과도하게 제약한다는 염려가 있는 것도 사실이다. 특히 자국의 문화에 영향을 미치는 경제활동에 대해서는 기존에 각국이 다양한 규제를 강력히 했지만, 이러한 문화정책상 규제 재량이 투자협정에 의해 어느 정도 제약되는지, 반대로 외국 투자자는 어디까지 보호를 받을 수 있는지가 정부나 기업 모두에게 중요한 문제가 된 것이다. 이러한 문제의 표출은 투자유치국이 문화적 가치를 위한 공익 규제를 할 때 주로 나타난다. 문화 분야에서 외국 투자자가 투자 유치국에게 규제를 받는 경우와 비문화 · 문화 분야에서 외국 투자자가 문화 보호 목적의 공익 규제를 받는 경우로 나눌 수 있는데, 전자는 문화산업의 보호에 관한 외자 규제 등에서 전통적으로 논의되어온 문제지만, 최근에는 후자와 같이 문화와 관련 없는 분야에서 외국 투자자가 투자 유치국의 문화정책과 충돌하여 투자 분쟁이 되는 경우가 주목받고 있다. 즉, 최근에는 단순한 산업 내 규제 문제를 넘어 훨씬 첨예한 ‘문화 vs 투자’의 가치 대립으로 표출되는 것이다. 문화 관련 분야의 외국 투자 유치는 매우 민감한 문제이며, 투자 자유화에 관한 국제 규약은 비교적 낮은 수준에 있다. 또한 투자 유치를 받아들인 후의 보호 단계에 관한 규칙에 대해서도 문화정책상의 규제 재량권을 잃을 수도 있다는 우려에서 투자협정에 포괄적인 문화적 예외 조항을 포함하는 정책을 취하는 국가도 있다. 그러나 ‘문화’의 개념 범위는 매우 넓고 포괄적인 문화적 예외 조항에서는 투자 보호와의 균형을 잃을 우려도 있기 때문에 예외의 사정을 더 명확하게 하는 입법적 노력이 요구된다.
Abstract
This research examines the tensions surrounding the balancing act between protecting cultural heritage and encouraging economic development. The article offers a set of recommendations to better ensure the protection of cultural heritage in the context of investor-state arbitrations. While economic globalization and international economic governance have spurred a more intense dialogue and interaction at a national level, the selfsame forces are threatening to jeopardize the cultural wealth of nations. Foreign direct investment is perhaps unmatched in terms of its capacity to change cultural landscapes and erase national memory. At the same time, increases in foreign direct investment have resulted in the creation of legally binding and highly effective regimes that promote and facilitate foreign direct investment in self-perpetuating ways. This article surveys a sample of investment arbitrations. It is demonstrated that international investment law has not lead to the development of any institutional machinery for the protection of world heritage through the settlement of investment disputes. This article shows, however, that in in recent years there has been a jurisprudential trend which has emerged that takes cultural heritage into consideration. After first defining the concept of cultural heritage disputes, this study analyzes and critically assesses such disputes and explores the use of cultural exceptions as a tool to prevent disputes in this field.
