환경범죄에 있어 인과관계에 관한 고찰

Abstract

As the heavy chemical industry and economic development policy continued after 70's, industrial public nuisance and environment pollution have been generated accumulately. According to these phenomena, problems about environment spread abroad farming and fishing villages and it makes us to need restriction about that kind of problem. But we couldn't make that environment protection harmonize with criminal law's own function about restriction. So, from now on, we need consideration for the development of more desirable environment criminal law and a direction of legislation through .deep legal research and consideration for punishment about environment crime. First of all, we should analyze differences between traditional law and environment law after recognizing a general idea of environment crime. Also, we should contemplate foreign lawmaking about countermeasures finally. We should confirm individuality in field of environment law, make a unified theroy and prepare harmonizing consolidation plan between each laws. But, above all, it is the most important thing to recognize that an illegal act about environment pollution is an act of crime to harm our society immensely, each of people do his best in doing own role as a observer, a state-organ get all sort of requisites and then do its utmost in improving efficiency.
