보건의료데이터의 활용과 정보보호에 관한 연구

초록

데이터 3법의 개정으로 그 어느 때보다 보험회사의 보건의료데이터의 활용 가능성은 높아지고 있으나, 현실적인 제약으로 인하여 그 활용이 제대로 이루어지지 못하고 있다. 이는 기본적으로 정부와 의료계가 보험산업에 대해서 부정적으로 바라보고, 보험회사를 신뢰하지 못하는데 기인하는 것이다. 즉 정부는 환자의 보건의료데이터가 보험회사에 제공될 경우에는 보험회사가 이를 악용하여 보험가입 거절 또는 보험금 지급 제한 등을 통해 소비자 권리를 침해할 목적으로 악용할 가능성이 높다고 판단하고 있는 것이다. 그러나 가명정보나 익명정보의 경우 그 자체만으로는 특정 환자를 식별할 수 없기 때문에 보험회사가 가명 의료정보를 이용하여 보험가입 거절이나 보험금 지급 거절 등의 목적으로 악용할 우려는 매우 낮을 것이다. 오히려 환자의 보건의료데이터가 대규모로 보험회사에 집적될 경우 보다 다양하고 정교한 보험상품을 개발할 수 있고, 효율적인 마케팅 활동 등이 가능해지게 된다. 나아가 보험업계의 헬스케어산업, 인슈어테크산업 진출 등 새로운 사업기회 창출에도 매우 긍정적인 영향을 줄 수 있다. 유럽, 미국, 일본 등 주요 선진국들의 경우 민간 보험회사에서 보건의료데이터를 제공받아 다양한 분야에 활용하고 있다. 그러나 우리나라의 경우 보험회사에 보건의료데이터를 제공하는 것에 대해서 다소 부정적인 시각이 지배적이다. 이는 세계적 추세에 맞지 않고, 다른 업종과 비교했을 때 형평성에 어긋나는 것이며, 개정된 데이터 3법의 취지와도 대치되는 것이다. 보험회사 또한 정부와 국민건강보험공단, 건강보험심사평가원 등과 공동 협의체를 마련하고, 보건의료데이터의 오남용 가능성에 대해서 불신을 해소하기 위한 적극적인 방안을 마련하여야 한다.

Abstract

The revision of the Data 3 Act has increased the possibility of using healthcare data by insurance companies more than ever, but it is not properly utilized due to realistic constraints. This is basically due to the government and the medical community looking negatively at the insurance industry and not trusting the insurance company. In other words, if the government provides the patient’s health and medical data to the insurance company, it is highly likely that the insurance company will abuse it for the purpose of infringing on consumer rights through refusal of insurance contract or restriction of insurance payment. However, in the case of pseudonym information or anonymous information, it is very unlikely that the insurance company will exploit the pseudonym medical information for the purpose of refusing to insure or restriction of insurance payment. Rather, if the patient’s healthcare data is integrated into an insurance company on a large scale, it will be possible to develop more diverse and sophisticated insurance products and to conduct efficient marketing activities. Furthermore, it can have a very positive impact on the creation of new business opportunities such as the healthcare industry and insurTech industry, etc. In major developed countries such as Europe, the United States, and Japan, private insurance companies are receiving healthcare data and using it in various fields. However, in Korea, there is a somewhat negative view on providing health care data to insurance companies. The failure to provide patient health care data only to insurance companies is inconsistent with the global trend, against equity compared to other industries and it does not fit the purpose of the revised Data 3 Act. The insurance company shall establish a joint consultative body with the government, the National Health Insurance Service and the Health Insurance Review and Assessment Service, etc. and prepare a plan to resolve distrust about the possibility of misuse of data.
