국회는 최근 셧다운 제도를 청소년보호법에 입법화하였는데 이 과정에서 관련 부처 간의 의견이 충분히 조율되지 못하였고 사실상 정책의 기본적 내용이 법제사법위원회의 심사과정에서 결정되었다. 이에 대하여 상임위원회의 법률안을 실질적으로 변경하는 식의 정책적 심사는 국회법상 법제사법위원회의 체계․형식․자구심사권의 범주에 포함되지 않는다는 비판이 제기되었다. 이러한 문제는 빈번하게 발생하고 있고 그에 따라 법제사법위원회는 상원과 같은 역할을 수행하고 있다고 비판되고 있다. 하지만 법률안의 내용에 대한 법제사법위원회의 실질적 심사는 국회법상 법제사법위원회의 체계․형식․자구심사권의 해석상 인정될 수 있다는 주장이 있다. 법률안의 합헌성 심사가 체계심사에 포함된다는 해석에 따르면 사실상 법률안의 모든 내용에 대한 심사가 체계심사권의 행사라고 정당화될 수 있다. 그러나 관련 법조항을 연혁을 중심으로 실증적으로 해석하는 경우에, 그리고 헌법의 원리 등을 바탕으로 목적론적으로 해석하는 경우에, 또한 현실의 상황에 비추어 정책적으로 해석하는 경우에도 법제사법위원회가 법률안의 내용에 대한 실질적․정책적 심사를 수행하는 것은 인정될 수 없다. 법제사법위원회는 순수하게 법률안의 형식적인 부분에 대한 심사만을 할 수 있고 이러한 심사는 각 상임위원회의 법률안 내용에 대한 심사를 보완하는 측면에서만 이루어질 수 있기 때문이다. 법제사법위원회의 월권적 행위의 문제점을 인식하는 입장에서는 법제사법위원회의 체계․형식․자구심사권 규정의 개폐를 요구하고 있으나, 관련 규정을 위와 같이 정확하게 해석한다면 이러한 요구는 불필요하다. 현행 국회법의 관련 규정이 정확하게 이해되고 준수된다면 법률안의 심의는 충분히 자연스럽고 적절하게 진행될 것이기 때문이다.
Abstract
The National Assembly of Korea recently legislated ‘shut-down’ program which prohibits minors' internet-game playing during the night. During legislation process, the core contents of ‘shut-down’ program had been decided in the Legislation and Judiciary Committee, not the Gender Equality and Family Committee which proposed the first draft of the program. However, this activity of the Legislation and Judiciary Committee has been criticized because the legal provisions of the National Assembly Act does not permit the Committee to examine or decide the contents of legislative bills. According to the Article 37 and 86 of the Act, the Legislation and Judiciary Committee has the power to examine systems, forms and wordings of legislative bills. If these articles are interpreted as the Legislation and Judiciary Committee can do a constitutionality test of bills, the Committee can take a substantive․policy test on bills and it is natural for the Committee to decide the core contents of bills. However, the positive interpretation of related provisions of the Act depending on historical documents and legal system of Korea indicates that the Legislation and Judiciary Committee has to do only a formal and supplementary review on bills which contents should be finally decided by the related committee. Given this positive interpretation, a better legislation process requires the Committee to understand and respect the meaning of the related provisions.
