Abstract

Recently, Korean Ministry of Justice is trying to introduce the Immunity of Accomplice Witness Act to Korean Criminal Procedure, saying that the truth of the crime can easily be confirmed if the immunity given to the accomplice witness was introduced to Korean Criminal Procedure. In this process, the pros of introducing immunity of Accomplice Witness Act, in order to justify the Immunity given to the Accomplice Witness Act trying to introduce, are claiming that U.S.C. also has the Immunity of Witness. Nevertheless, the contents of Immunity of Witness Act of U.S.C. has not clearly been introduced in Korean Scholar Circle. So this article is consisted as following: the constitutionality of Immunity of Witness of U.S.C., its developing history, its contents, comparing the 2010 year-draft of Immunity of Witness of Korean Criminal Procedure with Immunity of Witness of U.S.C.. Even if whether Immunity of Witness is co-existentive with the privilege against self-incrimination have been disputed in Criminal Scholar Circle of U.S., Immunity of Witness of U.S.C. is co-existentive with the privilege against self-incrimination. Its Immunity of Witness have been changed. Transactional Immunity was changing to use immunity, this use immunity was changing to use and derivative use immunity. In case of transactional immunity, if a witness bear the testimony, he may be exempted from prosecution of the crime regarding with testimony. In case of use immunity, the testimony of witness may not be used in subsequent prosecution of witness. Then the Supreme Court of U.S. ruled the use immunity was not coexistentive with the privilege against self-incrimination, because according to use immunity, the testimony of witness may not be used in the subsequent prosecution of witness, but fruits derivative from the testimony may be used in th subsequent prosecution, so derivative fruits against the witness. While Immunity of Witness of U.S.C. can prevent the U.S. attorney from discretion abuse of prosecution of crime relating with testimony through the approval of the Attorney General, ect. and the requisite of witness immunity, Immunity of Witness of the Korean Criminal Procedure of 2010-draft may not prevent the prosecutor prevent from its discretion abuse, because whether prosecutor indict or not the accomplice witness leave at a prosecutor’s disposal.
