조난선박 지원에 관한 법제도 개선방안

최근 코로나19의 대유행은 세계적으로 사회, 경제, 문화, 산업계에 부정적인 영향을 미치고 있으며, 감염자의 확산은 선박의 운항에도 다수의 문제점을 야기하고 있다. 특히, 선박에서 코로나19에 감염된 선원과 여객이 발생하면서 해당 선박에 대한 입항을 허가하지 않는 연안국이 나타나기 시작하였고, 선내 코로나19의 발병으로 정상적인 선박 운항이 불가한 조난상황에서 선박에 대한 적절한 지원이 이루어지지 않아 피해가 확대되고 있다. 감염병을 비롯한 선박사고로 인하여 조난상황에 빠진 선박을 효과적으로 수습하기 위해서는 연안국의 적절한 선박피난처 제공과 피난처에서의 기술지원, 의료지원, 감항성 회복을 위한 지원 등 적극적인 지원활동이 필요하다. 선박피난처는 선박의 손상으로 원조가 필요한 선박이 그 상태를 안정시키고, 항해에 대한 위험을 줄이며, 인명과 환경을 보호할 수 있는 조치를 취할 수 있는 장소를 의미한다. 조난선박에 대한 선박피난처를 제공하는 것은 선박사고의 수습과 제2차 피해의 예방에 효과적이며, 국제사회에서도 각 국가에 선박피난처를 지정하여 운영할 것을 권고하고 있다. 그러나 우리나라는 조난선박에 대한 선박피난처 제공과 적극적인 지원, 조난의 개념 확장에 관한 논의가 미흡한 실정이며, 구체적인 법제 또한 다소 부족한 부분이 있다. 만약, 우리나라 근해를 항해하는 선박에서 코로나19 집단감염이 발생하여 선박피난처를 요청한다면, 우리나라 정부의 대응과 지원이 어려울 것으로 판단된다. 따라서 이 논문에서는 조난선박의 개념 및 선박피난처의 필요성과 관련 사고 사례를 검토하고, 조난선박에 관한 국내외 규범과 대응 현황을 분석하여 조난선박 지원에 관한 국내 법제의 문제점을 도출한다. 이를 중심으로 우리나라 근해에서 발생한 조난선박에 대하여 적절한 피난처를 제공하고, 효과적으로 지원하기 위하여 우리나라의 법률 및 제도 개선방안을 제안하고자 한다.
Abstract
The recent global COVID-19 pandemic has had a negative impact on society, economy, culture, and industry worldwide. Specifically, there are problems such as crew or passengers infected with COVID-19, and port entry delays and refusals. There was a case where a ship was refused to enter a port as the crew and passengers were infected with COVID-19. Ships that were refused to enter ports without proper measures by neighboring countries were forced to witness an increase in material and human damage. In order to respond to ships in distress due to a variety of vessel accidents, including an unexpected crisis such as COVID-19, neighboring countries should provide appropriate places of refuge and conduct active support efforts such as providing technical and medical supports, and measures for recovery of seaworthiness. A place of refuge means a place where a ship in need of assistance can take measures to stabilize its condition, reduce the hazards to navigation, and protect human life and the environment. Providing place of refuge for ships in distress is effective in resolving accidents and preventing secondary damage. The international organization also recommends that each country designate and operate places of refuge. But there have been inadequate discussions on the provision of shelter for ships in distress, active support, and expansion of the concept of distress in South Korea, and the national legal system is also lacking to some extent. If a COVID-19 mass infection occurs on a ship sailing off the coast of South and a place of refuge is requested, it will be difficult for the South Korea government to respond and support. Therefore, this study reviewed the concept of distress, the necessity of providing place of refuge and related accident cases, and also examined the international norms and responses regarding the provision of support to ships in distress. Furthermore, the areas that require improvements were identified by analyzing the national legal system and the response status for ships in distress. With this as the focus, this study tried to provide solutions to the problems by suggesting policies and measures for system improvements and legal system modifications related to supporting ships in distress.
