초록

전 세계적으로 자율운항선박 기술개발이 가속화 되고 있는 현재 앞으로 자율운항선박이 해운산업에서 어떻게 구현될 것인가에 대한 국제적 관심이 높다. 특히, 이러한 자율화 기술을 촉진시키고, 실현시키기 위해서는 규제 장벽을 식별하고, 새로운 제도적 장치를 마련하는 것이 중요할 것이다. 본 논문은 자율운항선박과 관련된 규범적 연구 중 그동안 논의되지 않았던 해상조난자 지원제공의무에 초점을 맞추었다. 해상조난자 지원제공의무는 전통적으로 하나의 관습법으로 간주되며, 국제사회에서 인도주의적 가치실현에 중요한 기여를 해왔다. 하지만 자율운항선박의 등장은 해상조난자 지원제공의무의 효과적 이행에 대한 근본적인 의문을 야기한다. 따라서 본 논문은 구체적으로 해상조난자 지원제공의무의 실무상의 한계를 파악하고, 그에 대한 적절한 대응방안을 제시하였다.

Abstract

There is great international attention about how Mass is implemented in the shipping industry from now on, as the development of the technology of Mass is accelerating. In particular, it will be essential to provide new institutional strategies and identify regulatory barriers, in order to facilitate and realise such autonomous technology. This study focused on the duty to render assistance in distress at sea, which has not been discussed so far, of the normative study related to MASS. Duty to render assistance in distress at sea has been considered as customary law, and its duty has been contributed to the realisation of humanistic value. However, the advent of MASS raises a fundamental question as to whether MASS is able to implement its obligation effectively. Hence, this study looked at practical limitations relating to the implementation of the duty to render assistance in distress at sea of the MASS and presented appropriate countermeasures.
