Double Down Interactive, Soto v.
Abstract
Social casino games refer to virtual casino games that mimic games such as roulette, poker, bingo, and slot machines, which provided through Internet services including social network service. Social casino games are basically free to use and require the purchase of game money such as virtual chips to continue game play. Even if a virtual chip is obtained through winning a game, refunding it in real cash is generally prohibited under the terms and conditions signed by users before game playing. Social casino games have not been considered gambling in the United States because there is no prize of real money for winning a hand of virtual poker or winning on a virtual slot machine. In recent years, however, discussions about whether social casino game is gambling have been centered around the U.S. federal courts with lawsuits in which game users claim compensations for game losses against social casino game companies. Examples include Phillips v. Double Down Interactive and Soto v. Sky Union in the state of Illinois, Mason v. Machine Zone Inc. in the state of Maryland, and Kater v. Churchill Downs in the state of Washington. The presence of different gambling laws and loss recovery acts in different states has led to different discussions on various issues, mainly on whether the open concept of 'thing of value' can be treated as a object of consideration or prize (components of gambling). Washington state uses this ‘thing of value’ concept in gambling regulations, and the federal appeals court in Kater case concluded that virtual chips that extend game use are valuable in themselves, regardless of whether they are exchangeable to real money or not, and that social casino games are gambling. However, in cases other than Kater case, federal courts did not rely on the notion of ‘thing of value’, and argued that consumption of virtual currencies (chips) that were not exchangeable to real money shoud be understood as expenditure for game use and could not be an economic loss. In other words, it was determined that prizes (losses), one of the elements of gambling, do not exist as clearly in social casinos games. Washington state also introduced legislative bills in 2020 that would not allow game users to claim damages from the exhaustion of purchased chips against social casino game companies, despite the federal appeals court decision in Kater case. At a time when questions are raised about the appropriateness of current regulations in Korea, which do not allow purchase of chips for a fee in social casino games, the U.S. federal judiciary's discussion over social casino games may have significant implications for us.
