독일군 사례분석을 통한 장병 권익보호체계 개선방안

Abstract

An effective protection system for military personnel benefits needs to be created and implemented in order to prevent damages concerning human rights issues, such as private Yoon's beating death which happened in the 26th Division of the Army. Various benefit protection systems already being put into effect inside the army have lost the confidence of the Government. Therefore, outside the army a separate and effective system should be prepared and conducted. As others have said, the National Assembly can control the situation by installing a German method of military ombudsman on the inside. However, it would be more effective to utilize the military subcommittee for Anti-Corruption and Civil Rights Commission, which was established in 2006, given the Korean security circumstances and political systems. The present problems which the Korean army is faced with derives not from institution, but from operation. Above all, in order to effectively operate the protection system for military personnel benefit, soldiers need to build up a consciousness of human rights. Subjects about human rights should be required in every curriculum, including the courses of high-ranking commanders, and be perennially repeated by instructors who are specialized in this field. Also, It is necessary to make a task force and fill the human resource positions necessary to take care of the civil petition. In addition to that, report procedures need to be simplified so that victims can quickly request help and provisions for their situation. Related statutes should also be revised regarding confidentiality. Once these are completed as stated above, it needs to be hammered home to the soldiers, by utilizing various ways of promotion, the fact that any soldier can make a request to an external institution. It is more important to strengthen the weak points of the existing system, and work on improving it, rather than adopting new system and undergoing trial and error.
