본 연구의 목적은 개인정보의 지속적인 유출 사고와 이에 따른 2차적 피해 발생에서 제기되는 잊혀질 권리의 필요성과 함의를 고찰하고 개인정보보호를 위한 각국의 입법과정과 법률체계를 비교한 후, 현행 한국의 개인정보보호법의 실상과 문제점 및 그 개선방안을 모색하는데 있다. 최근 급속히 진척되고 있는 정보 사회의 도래는 소셜네트워크 서비스(SNS)의 획기적인 발전을 가져와 언제나 누구든 어떠한 정보에도 손쉽게 접근할 수 있는 사이버스페이스 상의 빅데이터 환경을 만들었다. 이로 인해 공공기관과 민간 분야의 모든 영역에 걸쳐 개인정보가 대량으로 유출되고 광범위한 전자통신망을 통해 빠르게 전파됨으로서 각 개인의 프라이버시권을 심각하게 훼손하고 신상털기 등 여러 가지 형태의 2차적 범법행위를 초래케 한다. 따라서 본 논문은 이러한 문제의식을 바탕으로 개인의 기본권을 보장하는 잊혀질 권리를 둘러싼 논의와 더불어 국내 개인정보보호법의 개선을 위한 다양한 측면에서의 실질적 방안을 제시하고자 한다. 이를 위하여 잊혀질 권리와 정보삭제권의 상호관련성에 대한 이론적 고찰과 더불어, 실제로 국내에서 발생하는 개인정보의 불법유출 실태와 신상털기로 이어지는 과정을 규명함으로써 잊혀질 권리의 중요성을 살펴본다. 끝으로 잊혀질 권리를 위한 정보삭제권에 대한 각국의 입법과정과 법률체계를 개괄한 후, 한국의 개인정보보호법이 내포하는 문제점과 개선방안을 제시한다.
Abstract
This study aims to analyze the need for the right to be forgotten and its implications in the light of recent continuous leaks of private records and secondary damages, to make comparison between legislation process and legal structures of different countries in the world, and to review the operation and problems of Privacy Protection Act of Korea and make recommendations for promoting privacy. Recently rapid emergence information society and subsequent development of social network services(SNS) resulted in an environment in which anybody can easily access to any information anytime. As a result, the large leak of private information has taken place and been rapidly disseminated through internet in both private and public sectors, which harms privacy rights and causes criminal behavior, becoming a social problem. Based on this observation, this article suggests ways to improve Privacy Protection Act, focusing on the right to be forgotten. In order to review the importance of right to be forgotten, theoretical analyses on relationship between the right to be forgotten and the right to delete personal data as well as on incidents of leak of private information and process of release of personal identities are provided. Finally, this article analyzes legislative history of selected countries concerning the right to be forgotten and discusses problems of Personal Information Protection Act and ways the improve the law.
