수용자 처우에 있어서 종교의 역할과 기능에 대한 고찰 - 구조변화의 의미를 중심으로 -

한국 교도소 수형자에 대한 가석방 적격 여부를 심사할 때 당사자의 종교 유무의 여부는 따지지 않게 되었다. 이 문제는 교도소 내 종교를 보는 커다란 시각 변화로 읽혀 질 수 있다. 종교는 주지하다시피 전통사회에서 규범 기준의 그 자체라고 할 수 있었고, 그 세속화의 과정은 현대를 탈종교적 성격으로 만들고 있다. 즉 종교는 그 자체의 절대적 독자성을 상실하고 삶을 영위하는 가운데 단지 하나의 선택지로 되고 있다. 이러한 전형적 예를 우리는 서양의 기독교에서 발견할 수 있다. 또한 이런 사실을 서구의 교도소 수형자의 종교의 문제에서도 역시 관찰할 수 있다. 미국을 위시한 서구의 교도소 내 종교의 자유문제는 세속화의 결과에 기인한다. 즉 사회적 마이너리티인 수형자들에 대한 종교적 관용은 가속되는 세속화의 결과로 파악할 수 있다. 그러나 전통적인 종교문화의 문맥이 전혀 다른 한국사회에 이러한 시각을 그대로 옮겨 놓을 수는 없다. 그러므로 한국에서 가석방심사 적격요건에서 종교 유무를 삭제시킨 배경을 기독교라는 종교의 세속화 결과로 이해해서는 결코 안 된다. 종교의 선택이 재소자들에 있어서 꼭 가석방요건을 갖추기 위한 것이 아니라면, 신앙은 스스로의 교화를 전제로 한 성숙한 결단의 계기로 이해되어야 한다. 그러므로 서구적 관점과는 다르게 한국 교도소 내에서 종교 인식지형의 변화는 오히려 종교의 자율적인 독자성을 획득했다고 말할 수 있다. 물론 그런 변화에 맞추어 교화과정 안에서의 선교, 혹은 포교의 내용과 전략의 변화가 전제 되어 있어야 한다고 사료된다. 더불어 중요한 사실은 그러한 의식구조의 변화를 요청하는 만큼 그에 상응하는 교도소의 물리적 조건에 대한 변화된 시각 또한 요청된다는 것이다.
Abstract
When the parole eligibility for the prisoners comes to be a judging situation, the issue whether they have religions is no more problematic. The issue might be rather interpreted as the great change of views for understanding the religious service in the prison. Religion generally is the standard of moral norm in the traditional societies, the process of secularization is being, nowadays, transformed, showing the post modern characterization of religion. Since we do not accept the indigenous meaning of the religion, we instead consider it as a humble choice of a life style to maintaining our life. We are easily be able to find these examples from the Western religion, namely, christianity, as well as from the religion of the prisoners of Europe and America. Meanwhile, the problem of whether the freedom of religion has be been due to the results of secularization. The religious tolerance to the prisoners of the minority group is based upon a sort of relational form of secularization. The views on the tolerance, however, cannot be treated in the Korean society of prison because of different contexts of culture and tradition. Thus, the reason that religion among the conditions of parole is deleted in Korea must be differently understood, considering the secularization as a European form of religion. Religious faith should be a chance for the mature choice that is based on the self corrections, if the choice of religious belief is for getting an interest of parole. Therefore, the fact that the parole system of Europe and America is not much effective means Korean prison system holds its own identity. Religious mission, of course, should be able to compromised with proper contexts and strategy of the mission, although all these difference is discovered as a real fact. In our society we have to bring an appropriate change for the parole system, changing the physical environment of the prison and the general views of our consciousness of the parole system.
