지적재조사에 관한 특별법상 경계결정위원회와 시･군･구 지적재조사위원회의 기능 재분배에 관한 연구

본 연구의 목적은 「지적재조사에 관한 특별법」상 경계결정을 심의･의결하는 경계결정위원회와 조정금 결정을 심의･의결하는 시･군･구 지적재조사위원회의 기능 재분배를 검토함으로써 보다 효율적인 지적재조사의 추진을 도모할 수 있는 방안을 제시하기 위함이다. 경계결정위원회와 시･군･구 지적재조사위원회는 그 위원의 구성적인 측면이나 역할의 특성 등에 있어서 중복성이 크므로 구태여 별도의 위원회로 운영할 실익이 적고, 경계결정과 조정금 결정 과정이 이원적으로 이루어짐으로써 상당 기일을 소요하고 있다. 이와 같은 문제에 대하여, 본 연구는 시･군･구 지적재조사위원회의 조정금 결정 기능을 경계결정위원회로 이관하는 방안과, 경계결정위원회의 경계결정 기능을 시･군･구 지적재조사위원회로 흡수･통합하는 방안을 검토한 후, 향후 법･제도적 개선책을 제안하였다.
Abstract
The purpose of this study is to propose the promotion plan for efficient cadastral resurvey business by examining the function redistribution between the BDC(Boundary Decision Committees) and the Si/Gun/Gu CRC(Cadastral Resurvey Committees) in Special Act on Cadastral Resurvey. There is no need to operate separately because the BDC and the Si/Gun/Gu CRC overlap greatly in terms of composition or characteristics. Furthermore, since the decision process of both committees is done in a dual way, it takes considerable time. Regarding these issues, this study considered a plan to transfer the function of the Si/Gun/Gu CRC to the BDC. In addition, a plan was reviewed to absorb and integrate the functions of the BDC into the Si/Gun/Gu CRC. Afterwards, we proposed the future legal and institutional improvement measures.
