Abstract
A “guidance period” is generally utilized as a system to inform new laws or regulations and prevent future violations prior to their full enforcement. As it requires new obligations, violations during this period do not immediately trigger fines, providing the public with an adaptation period. However, in the absence of a clear legal basis, the establishment and operation are left to the discretion of administrative agencies. This leads to inconsistent practices during the guidance period, causing practical confusion, undermining administrative predictability, and ultimately eroding public trust in government. This study examines whether administrative agencies may lawfully impose fines for violations committed during the guidance period. Administrative fines, which are non-criminal sanctions, and the establishment and operation of guidance periods both fall within the scope of administrative discretion. Accordingly, the legality of imposing fines during the guidance period must be examined in light of general principles of administrative law governing the limits of discretionary power. In principle, a guidance period involves a public declaration by an administrative agency that fines will not be imposed for a certain period; therefore, imposing fines contrary to such a declaration violates the principle of legitimate expectations. Nevertheless, exceptional cases may justify the imposition of fines, particularly where violations substantially harm public interests or the rights of third-parties. Even in such cases, imposition must be strictly controlled under the principles of equality and proportionality. Thus, legislative clarification of the legal status of guidance periods is required to enhance administrative predictability and consistency, while contributing to the realization of constitutional values such as the separation of powers and the rule of law.
