부동산등기용 등록번호 부여절차 개선방안에 관한 연구

Abstract

The research focuses on the legal and institutional investigation of not only the conditions and procedures of granting numbers of real estate registration for non-legal persons or foreign legal persons but also the management of the changes of the numbers concerning the civil appeals at municipal level. The results are summarized as follows:Firstly, the provision in Real Estate Registration Act that a foreign legal person is regarded as a domestic non-legal person should be amended because the act does not provide for the process of issuing a registration number to a foreign legal person with substantive statements.Secondly, the applicant information only requires the name and address of a representative director but a custodian can also apply for issuing the registration number in fact, so the related provisions should be revised appropriately.Thirdly, in case the input mistakes of registration numbers happen or registered items are changed, the Real Estate Registration Act needs to be revised in order that the mistakes are corrected and altered items updatedLastly, the act requires to provide that causal documentation is essential to alter the owner's name and/or other registered items of a property or to maintain the concurrency between the registered items of real estate registration numbers and the information of property owners. The study additionally results that the registration number should be 5 digits instead of the present 4 digits to avoid the duplication of the registration numbers issued to foreign bodies.
