강간범의 범행동기에 대한 논의는 그 관점에 따라 다양하게 논의되고 있지만 강간범의 심리는 상당부분 동일한 특징을 보이고 있음을 알 수 있다. 그런데 특히 아미르나 울프강 및 페라쿠티 등의 주장과 같이 폭력적인 하위문화의 한 패턴으로써 강간의 이유를 설명할 경우나 오브리엔의 권력통제이론 등은 한국사회의 강간 혹은 성폭력현상을 이해하는 데에도 꽤 설득력이 있다고 보여진다. 특히 우리 사회에 만연된 여자청소년을 상대로 한 성매매는 더욱 사회적 불평등의 한 단면으로 보여지며, 변형된 폭력의 한 유형으로 이해할 수 있다. 강간범의 범행동기를 심리적 열등감과 제대로 통제되지 못한 공격적인 성욕으로 이해한다면 강간범은 처벌의 대상이자 동시에 치료의 대상으로 그 지위가 변한다. 즉, 적당한 약물치료, 상담치료 등의 의학적인 치료가 병행되지 않으면 강간은 늘 현재진행형이 될 것이다. 이들에 대한 처벌과 치료의 경계는 어느 정도로 할 것인가에 대한 사회적인 합의가 필요하다.
Abstract
There are lively diverse discussion on motive of rape. But there are same distinction. Exactly, a distorted sexual impulsion and forcible attitude. By the way, violent subculture theory of Amir and Ferracuti and Wolfgang is very effective method to explain rape in korean society. The power-control theory of O'Brien is also same. Especially, recently many prostitution which are adult men to female juvenile look inequality of sexual power in korean society. It is a deformed sexual violence. If we understand mental disorder and uncontrolled attactive sexual impulsion about rape, the status of rapists is change to medical treatment client. Exactly, proper medicine and counselling are provide to the rapists. But we have to social consensus about guideline of medicine treatment and penality to rapists.
