유럽인권재판소의 소수자에 관한 사례는 세 가지로 분류할 수 있다. 첫째, 국가 또는 사인에 의한 인종과 민족에 따른 차별적 취급의 문제, 둘째, 소수자 집단의 활동이 국가 안전보장, 질서유지라는 이유로 제약을 받는 경우, 셋째, 문화적・종교적 소수자 집단의 활동이 소수자라는 이유로 제한을 받고 차별적 취급을 받는 경우이다. 소수자의 인권을 보장하는 과정에서 차별의 철폐, 실질적 평등의 보장, 집단 간의 대등한 관계를 전제로 하는 대화, 특히 소수자와 관련된 사항을 결정하는 과정에 소수자의 참여를 전제로 한 소수자의 평가, 즉 소수자를 인권 및 특별한 권리의 주체이며, 판단과 결정의 주체로서 평가할 수 있는지 여부, 모든 정책의 입안과 시행에서 소수자의 정당한 이익을 적절하게 고려해야 한다는 유럽인권재판소의 결정례에서 나타나는 판례의 경향은, 유럽 일부 국가에서는 합법적인 인종차별과 다수와 소수자를 분류하기 위한 방법으로 선별적 입국정책관리정책의 채택과 체류하는 외국인에 대한 관리・감독의 강화가 확대되고 있는 상황에서, 소수자의 권리에 대하여 시사하는 바가 크다고 할 것이다.
Abstract
Die Europäische Konvention für Menschenrechte hat keine ausdrückliche Bestimmungen für den Schutz der Minderheitenrechte. Aber der Europäiosche Gerichthof für Menschenrechte hat die Minderheitensrechte von Art. 14 der Europäischen Konvention für Menschenrechte, d.h. von Diskriminierungsverbotsbestimmung abgeleitet. Dieser Aufsatz hat die Entscheidungen des Europäioschen Gerichthofs für Menschenrechte über Religion, Sprache, Lebensstil der Minderheiten, insbesondere über zwei Fälle "Case of Chapman v. the United Kindom" und "Case of Podkolzina v. Latvia" untersucht.
