지방자치단체는 헌법 제117제에서 밝히고 있는 바와 같이 주민의 복리에 관한 사무를 처리하고 재산을 관리하며, 법령의 범위 안에서 자치에 관한 규정을 제정할 수 있다. 지방자치단체의 사무에는 일반적으로 고유사무와 위임사무가 있다고 본다. 그리고 주민의 복리에 관한 사무는 원칙적으로 지방자치단체의 고유사무로 인정하려 한다. 지방자치단체가 실질적으로 주민복리의 증진을 위하여 활동하기 위하여는 지방자치단체의 독립이 보장되어야 한다. 주민의 복리를 증진시키는 것은 전국적으로 천편일률적으로 행하여 질 수 있는 것이 아니다. 지역간의 특색을 살려 각 지방자치단체에 가장 적절한 형태의 방법을 찾을 수 있어야 하고 각 지방자치단체의 특색을 살려 각자의 방법대로 수행될 수 있어야 한다. 따라서 이는 필연적으로 지방자치단체의 독립을 필요로 한다. 지방자치단체의 독립에서 첫단추가 되는 것은 조직·인사권의 독립이다. 지방자치단체가 정립되면서 그 실질화를 추구하는 첫 단추도 역시 조직·인사권의 독립이다. 그러나 이러한 지방자치단체의 조직·인사권의 독립에 있어서는 그에 있어서의 ‘구체적 범위’를 정한 위임이 인정되지 않고 있는 위임입법의 문제점, 지방자치단체에 존재하는 국가공무원의 문제점, 지방인사위원회의 문제점, 총액인건비 제도의 문제점 그리고 공무원교육의 강화필요성이 논의 되고 있다.
Abstract
Local government should manage the affairs for the welfare of inhabitants. But sometimes the management of local government should be the object of the regulation and control from the central government. Local autonomy is the main issue of the local government. How can do they manage best for the welfare of inhabitants? Every local governments could have its own way to reach there. And the regulation and control from the central government could be the obstruction. So the independence from the central government is very important for the local government to service for the welfare of the inhabitants substantially. And first step to reach the independence is to have organizing and personnel managing power independently. But there are some problems - problem of legislative delegation, problem of national public officials in the local government, problem of local personnel committee, problem of total-sum system in the personnel expenses and the necessity of the education for the local government officials. And they must be studied carefully and must be devoted to find the answers to solve them.
