Abstract
There are recently raised arguments for granting legal personhood to artificial intelligence robots. A motivation for such arguments is to enable electronic person to possess properties and thus hold liabilities for their own damages with the possession. This article proposes specifics under the assumption of electronic person, independently from the controversy on the necessity for the introduction of electronic person. Artificial intelligence robots, essentially objects by nature, must be recognized with the legal personhood only when a set of prerequisites are satisfied. A corporate body model must be applied to determine when legal personhood starts and ends. A registration system where the capacity for rights may be acquired through a registration of the establishment of electronic person and ceased through a registration for termination of electronic person. I propose to adopt the address and disappearance, yet with an additional suggestion to validate the effect of disappearance with the report by an owner instead of decisions of the court such as a declaration of disappearance. Even in situations when the capacity for rights is granted to electronic person, unlike in the case with natural individuals, it is inevitable to put limitations on the granted capacity. Legal personhood cannot be granted the capacity for personal rights derived from human dignity, inheritance permitted only within certain family relations, and comprehensive bequest incurring the same rights and duties as inheritance. In addition, it is unnecessary to acknowledge the exceptional capacity for rights as to fetuses or body corporate without legal personhood. However, if the legal personhood of artificial intelligent robots is acknowledged even to a limited extent, the admissibility of a party to legal proceedings defined by the Legal Procedure Code and the capacity for registration of real property must also be acknowledged.
