범죄 행동의 연관성 분석에 관한 연구 - 인천 모자살인 사건에서의 범행과정을 중심으로 -

범죄자는 늘 완전 범죄를 꿈꾼다. 인터넷, 매스컴을 통한 자료 수집이 용이한 환경 하에서 범죄자들은 필요한 자료를 수집하고 참고하여 범죄를 구상하고 실천한다. 범죄 관련 프로그램들이나 범죄관련 서적 등을 쉽게 접할 수 있고, 범행 대상이나 범죄 형태에 적합하게 주제별로 맞춤형 준비를 할 수도 있다. 그러나 그런 시도가 있을 것이라고 추정할 뿐 구체적으로 계획을 세워 단계별로 준비하고 있는 과정이 자세히 밝혀진 사례는 보기 힘들다. 소위 인천 모자 살인사건이라고 불리는 동 사례는 돈을 위해 차남 부부가 어머니와 장남을 살해하고 범죄 사실을 은폐하기 위한 과정들이 밝혀진 사건이다. 완전 범죄를 위해 준비하고 모의하는 과정과 사건 이후 범행 사실을 은폐하고 수사를 방해하기 위한 여러 노력들이 그대로 노출되었다. 특히 범죄 은폐에 그치지 않고, 수사망이 조여들자 수사기관을 곤경에 몰아넣는 역공을 사용했다는 점도 특이하다. 마지막까지 범죄 가담 사실을 부인하던 차남의 처가 결백을 주장하며 수사 과정상 강압수사 등의 문제점을 제기하며 자살하였다. 그러나 이후 그녀가 공범이었음을 강하게 시사하는 CCTV 영상이 확보되어 피의자의 죽음이 커다란 의미가 없어져 버렸다. 또한 범행을 위해 서적과 동영상 자료를 구해 보거나 피해자 살해 후 사체 처리 방법을 연구한 것으로 드러나 범행준비에 사용된 것으로 추정되는 서적들과 동영상 자료들의 분석은 범죄자의 심리 메커니즘을 살펴 볼 수 있는 좋은 기회라고 생각되어 범인들의 범죄 심리를 단계별로 분석을 시도하였다.
Abstract
Criminal offenders dream the perfect crime. Generally, criminal offenders collect and utilize the necessary materials through internet or mass media. Therefore it is not difficult to plan and commit criminal behaviors as motivated criminal. A motivated criminal, who has interest to execute crime, will try to contact with criminal analysis programs in TV or criminal books to obtain valuable informations. Those predictions was assumed however there are no eminent evidence whether they try to prepare criminal behaviors through procedures actually. Unfortunate criminal case that was happen at Incheon province, it was called ascendant murder case by younger son. During murder procedure, 27 years old younger son killed his mother and older brother to obtain a properties and money, he & his wife concealed a murder case as missing accident. It is interesting to check this murder case. He and his wife tried to hide and made endeavor to confuse the investigators. Also more earlier to do the crime, they bought the detergent to wipe out the blood stains. After they killed two family members, they tried to make use of investigator activity and to take counter offensive behaviors. The analysis of this case is useful opportunity to find criminal’s psychological mechanism. After the co-offender, second son’s wife, blamed the police authority and suicided herself, many evidences proved that they were involved with the murder case deeply. For instance, the CCTV film which was discovered at the store, tells they bought some devices and materials for criminal behaviors. Especially, they down loaded films which were related with crime for cope with investigation activity & collected and studied many criminal books. We tried to analyse the criminal psychology through relations with films, books and their criminal behaviors
