연쇄살인사건에 있어서 범인상 추정에 관한 연구 - 화성 연쇄살인 미수 사건 / 강간사건 연관성 분석을 통한 범행 수법(modus operandi)과 인증(signature) 비교를 중심으로

우리나라보다는 서구에서 상대적으로 많이 발생하는 것으로 그동안 인식되어 왔던 연쇄살인은 이제는 우리 사회에서도 자주 회자될 정도로 익숙한 용어가 되었다. 그 이유는 화성연쇄살인 사건 이후 심심찮게 발생되어 왔던 여러 가지의 연쇄살인사건 때문일 것이다. 이와 함께 주목받고 있는 용어로 범인상 추정(criminal profiling) 기법이 있다. 그러나 범인상 추정(criminal profiling) 기법은 일반적으로 알려진 것 같이 살인 사건을 해결할 수 있는 전가(傳家)의 보도(寶刀)는 아니다. 다만 범인상 추정을 통해 범죄해결에 간접적인 역할을 하고 있지만 결코 무시할 수 없는 하나의 방법이다. 사건을 해결하지 못하고 결국 미제사건으로 남는 이유에는 여러 가지가 있겠다. 수사기관의 조사능력이 부족하거나 관계자료 확보의 어려움으로 인하여 전후 사건 간 서로 어떠한 연관이 있는지를 제대로 파악하지 못하는 경우도 있다. 또한 수사기관이 어떤 이유로 인하여 연쇄성이나 관련성을 부정하는 경우 선행하여 발생했던 사건들과 이후 발생한 살인사건이 모두 동일한 범인에 의해 일어난 살인사건일 가능성이 매우 높음에도 불구하고 사건간의 관련성이나 연속성, 연쇄성을 분명하게 파악하지 못하는 연관성 파악불능(linkage blindness)은 사건 해결에 커다란 장애가 되고 있다. 화성연쇄살인 사건 역시 수사에 있어서 연관성 파악이라는 점에서 본다면 실패한 사례이다. 그러나 최근 발굴된 후 일반에게 알려진 화성연쇄살인 사건 현장 부근 강간 사건들의 존재는 연쇄살인사건과의 연관성을 파악하는데 있어서 중요한 의미를 가진다. 그 이유는 연쇄살인 사건 중 유일한 생존자가 남아 있는 미수사건과 강간사건 피해자들의 증언과의 연관성을 중심으로 범인상 추정(Criminal Profiling)의 가능성이 일말의 고리가 될 수 있기 때문이다. 따라서 본 연구에서는 화성 연쇄살인 사건 이전에 발생했던 강간사건과 연쇄살인 사건 과정상 미수사건 과정에서의 범행 수법(MO)이나 서명행위(Signature) 등의 비교를 통해 그동안 시도되었던 제한된 범인상 추정을 보다 구체화하고자 한다.
Abstract
Before 1980s, the word "Serial Killer" was unfamiliar to Korean society as most Korean had recognized that most serial killing had happened at western society. However serial killer become familiar to Korean since Hwa sung area serial killing cases since 1990s. Criminal Profiling attract public attention with serial murder cases. Criminal Profiling is indirect method to solve criminal case, therefore this is not a cure -all to bring a solution of crime. There are many reasons of unsolved criminal cases. For instance, the limitations of investigation agencies or fail to collect useful investigative information. The most plentiful reason is to fail to connect linkage criminal cases. This was called as linkage blindness. Hwa sung serial murder cases are the typical frustrated investigation processing. Fortunately rape cases which had happened at Hwa sung area were discovered by press recently. These cases were reported to police 1990s during investigation processing already. However police didn't try to connect with serial murder cases. These connections among rape cases and serial murder cases are extremely meaningful. Because it is possible to compare an attempted serial murder case's alive survivor's testimony and rape case's victims'. As result it is not difficult to trace linkage for criminal profiling. This study is consist of actualization of criminal profiling through the comparison of Modus operandi and signature during rape and serial murder processing.
