주요국의 투자이민제도의 비교분석 및 정책적 시사점: 미국, 캐나다, 호주, 홍콩의 사례를 중심으로

본 연구의 목적은 주요 선진국(미국, 캐나다, 호주, 홍콩 등)들의 투자이민제도를 비교분석하여주요국의 투자이민제도의 주요내용과 특징을 파악한 후 이를 토대로 우리나라 투자이민제도에 대한정책적 시사점을 제시하는 것이다. 이를 위해 문헌연구를 통해 4개국의 투자이민제도의 개요, 조건및 혜택, 관리･운영체계, 투자실적 등을 비교분석하였다. 연구결과를 요약하면 다음과 같다. 첫째, 투자이민제도의 근거법으로는 미국, 캐나다, 호주는 이민법을, 홍콩은 투자이민법을 운영하고 있다. 둘째, 투자금 운영기관을 비교하면, 미국은 이민청 승인 하에 지역센터(Regional Center), 캐나다는 이민부 지정 주정부, 호주는 연방 이민부 지정 연방･주정부 재정공사, 홍콩은 이민국 지정 금융기관이 투자금 운영기관을 담당하고 있다. 셋째, 투자금 운영방식은 미국과 홍콩은 손익발생형인데 반 해, 캐나다는 원금보장･무이자형이고, 호주는 이자지급형이다. 마지막으로, 우리나라 투자이민제도에 대한 시사점으로는 간접투자 이민제도 유형의 다양화, 간접투자 대상 자산의 다양화, 투자자금회수 및 영주권 부여 검토, 신축적인 제도운영이 필요한 것으로 나타났다.
Abstract
The purpose of this study is to analyze the Investment Immigration System of four advanced countries (USA, Canada, Australia, and Hongkong) and to suggest its policy implications to South Korea. For achieving this goal, this study summarized and reviewed previous literature regarding the synopsis, conditions and benefits, management operating system, and actual output of the investment immigration system in four countries. The results of this study are as follows. First, as a legal ground for the investment immigration system, USA, Canada and Australia use the Immigration Act, whereas Hongkong utilizes the Investment Immigration Act. Second, in terms of investment of operating agency, USA has Regional Center under US Citizenship & Immigration Services; Canada has state governments authorized by Citizenship & Immigration Canada; Australia has Treasury Corporations under Department of Immigration; and Hongkong uses financial agency under Immigration Department. Third, in a view of investment operation, USA and Hongkong are the form of profit and loss; Canada is the form of capital protection with no interest; and Australia is the shape of interest payment. Finally, the policy implications of this study for the investment immigration system in South Korea are the following: it turns out to suggest that the diversification of indirect investment immigration system, the expansion of indirected investment assets, the guarantee of retrieval to investment money, and flexible operation of the system are needed.
