기술적 보호조치 무력화 금지에 대한 예외 고시에 관한 연구 — 저작물에 대한 시청각장애인의 접근성 —

초록

우리 저작권법에는 시각장애인과 청각장애인을 위한 저작재산권의 제한 규정이 있고, 미국 저작권법은 시각장애인을 위한 저작재산권 제한 규정이 있고 청각장애인에 대해서는 제107조의 공정이용 규정을 적용할 수 있다. 미국은 2018년에 마라케시 협정을 이행하기 위해 시각장애인을 위한 규정인 제121조를 개정하였는데, 이때 대상 저작물에 어문저작물 외에 ‘문서 또는 악보의 형태로 고정되어 이전에 출판된 음악저작물’을 포함시켰다. 그런데 저작물의 정당한 이용이 접근통제 기술적 보호조치에 의해 불합리하게 영향을 받는 경우에 이것의 무력화 금지에 대한 추가적인 예외로 규정될 수 있다. 미국은 위와 같이 제121조를 개정한 후에 무력화 금지의 예외 규정을 개정하였고, 영상저작물에 대해서도 기존의 허용범위를 합리적으로 확대하였다. 그런데 2021년의 미국 룰메이킹 결과는 우리나라의 2021년 고시가 제정된 후에 나온 것이다. 이에 따라 미국의 예외들 중에서 개정된 접근성 규정들에 대한 검토가 필요하다. 우선 특히 시각장애인이 음악저작물을 다양한 방식으로 향유하고 창작할 수 있도록 할 수 있다는 점에서, 어문저작물 외에 이와 유사한 형태의 특정한 음악저작물에 대해 예외 규정을 마련한 것은 상당히 의미가 있으므로, 우리 고시도 마라케시 협정을 고려하여 최소한 미국과 같이 문서 또는 악보 형태의 음악저작물의 이용이 적절하게 이뤄질 수 있도록 할 필요가 있다. 그리고 영상저작물에 관하여 ‘그 기능을 제공하는 다른 영상저작물이 있는 경우’는 너무 포괄적인 제한으로 보이므로, 미국 예외 규정을 참조할 필요가 있다. 그리고 미국 예외 규정과 달리 우리나라의 고시에는 행위자에 관한 내용이 없고 저작재산권의 제한 규정에서 ‘대통령령으로 정하는 시설’로 행위자를 한정하고 있다. 그렇지만 이 시설에는 대학과 관련한 직접적인 언급은 없어 이에 대한 개정을 검토할 필요가 있어 보인다.

Abstract

The Korean Copyright Act has provisions restricting on author's property rights for the visually impaired and hearing impaired, and the US Copyright Act has the provision restricting on author's property rights for the visually impaired and the fair use provision of Article 107 that can be applied to the hearing impaired. In 2018, the United States amended Article 121, a provision for the visually impaired, to implement the Marrakesh Agreement, which included ‘previously published musical works that have been fixed in the form of text or notation’ in addition to literary works. However, if the legitimate use of the work is unreasonably affected by the access control technological protection measures, it may be stipulated as an additional exception to the prohibition of its circumvention. After revising Article 121 as above, the United States amended the exception to the prohibition of circumvention, and reasonably expanded the scope of permission for motion pictures. However, the US rulemaking result for 2021 came after Korea's 2021 notice was enacted. Accordingly, it is necessary to review the revised accessibility provisions among the exceptions as a result in the United States. First of all, the provision of exceptions for specific musical works of a similar type other than literary works is quite meaningful, especially in that it enables the visually impaired to enjoy and create musical works in various ways. Therefore, it is necessary for our notice to ensure that the use of ‘previously published musical works that have been fixed in the form of text or notation’ can be done appropriately, at least as in the United States considering the Marrakesh Agreement. And with regard to motion pictures, it is necessary to refer to the U.S. exception provision, as ‘when there is another motion pictures that provides the function’ is too comprehensive limitation. And unlike the US exceptions, there is no reference on the actors in the Korean notice, and the restrictions on author's property rights limit the actors to ‘facilities prescribed by the Presidential Decree’. However, there is no direct reference to the university in this facility, so it seems necessary to consider a revision of it.
