Abstract

In general, the right of innocent passage of ships is an established norm under international law, but regarding that of warships, explicit mention of whether to allow it is avoided in the UN Convention on the Law of the Sea. As reflecting this, many countries require prior approval or prior notification as a condition of territorial passage of warships, resulting in a number of disputes between flag and coastal countries over unauthorized territorial passage of foreign warships. The reason for this is that the failure of compromise between maritime and coastal countries in the process of codifying the concerning law has left the current ambiguous texts in the Convention. If this conflict phenomenon is neglected, it may cause ruinous international disputes, so the international community's immediate and active attention is necessary at present. In fact, unlike ordinary merchant ships, warships are a medium that implements national policy militarily, so coastal countries keep an eye on the movement from a different perspective compared to general merchant ships' passage. In other words, since a warship is a platform that implements national policy with armed power along with the characteristics of representing the flag country, interested parties are paying close attention to its suspicious movement and activities. In that sense, many coastal countries require preconditions for passage, such as prior approval or prior notification, for foreign warships passing through their sovereign territory. If a foreign warship passes through the territorial sea of those countries without permission, those will refuse the passage on the grounds of infringement of territorial sovereignty, or if necessary, take a strong response under self-defense. As such, many coastal countries require minimal legal protection because foreign warships' territorial passage causes inevitable security tensions, but nevertheless it has not been established under international law due to international antagonism and confrontation. What is worrisome is that a series of potential provocative actions in the coastal sea, such as maritime intelligence gathering, could cause high-intensity disputes, which requires preventive active attention and cooperation from the perspective of international peace and stability.
