Abstract
The Fair Trade Commission imposed a fine of 95 billion KRW on Southeast Asian liner shipping companies for their collective rate-setting practices. Evergreen Marine Corp. objected to this and filed a lawsuit for cancellation. The High Court accepted this and held that only the Minister of Oceans and Fisheries has regulatory authority. It was stated that, both historically and in terms of regulatory methods, the independence of the system could be recognized. The Supreme Court denied this, ruling that Article 29 of the Maritime Transport Act is also under the umbrella of the Monopoly Regulation and Fair Trade Act and must be reviewed under Article 58 of the former Fair Trade Act. If the conduct is not reported, Article 29 of the Maritime Transport Act does not apply, and ultimately, the Chairperson of the Fair Trade Commission may also have regulatory authority. Nevertheless, the Supreme Court quashed and remanded the High Court’s decision for failing to discuss this point. The Supreme Court’s ruling needs to be reconsidered, as it did not properly refute the High Court’s arguments regarding the historical background and independence of the Maritime Transport Act.
