본 논문은 서울고등법원 2024. 2. 1. 선고 2022누43742 판결을 중심으로, 외항 정기선사의 해상운임 공동행위에 대한 공정거래법 적용의 타당성과 한계를 검토한다. 해당 사건은 공정거래위원회가 한국-동남아 항로에서 장기간 운임 담합을 이유로 정기선사들에게 과징금을 부과한 데서 비롯되었다. 서울고등법원은 해운법 제29조의 규정에 따라 운임 협약은 해양수산부의 감독 하에 이루어지는 정당한 공동행위로 판단하고, 공정거래위원회의 제재는 권한을 일탈한 위법한 처분이라 판시하였다. 본 연구는 판결의 법리적 논거를 분석하고, 해운법과 공정거래법 간의 관계, 해운산업의 특수성, 국제적 경쟁법 적용례를 비교함으로써, 현행 규제 체계의 문제점과 입법적 개선방향을 제시하고자 한다. 특히, 공정거래법의 이중적 적용이 초래할 수 있는 규제 충돌, 불확실성, 해운산업 경쟁력 저하 문제를 지적하며, 규제의 명확성과 일관성을 확보할 필요성을 강조한다.
Abstract
This study analyzes the Seoul High Court's decision rendered on February 1, 2024 (Case No. 2022Nu43742), which addressed the applicability of the Monopoly Regulation and Fair Trade Act (MRFTA) to freight rate agreements among liner shipping companies. The case arose from the Korea Fair Trade Commission's (KFTC) imposition of penalties on liner carriers for engaging in alleged freight rate collusion on the Korea-Southeast Asia route. The court held that such agreements constituted legitimate joint actions under Article 29 of the Shipping Act, supervised by the Ministry of Oceans and Fisheries, and thus fell outside the regulatory authority of the KFTC. This paper critically examines the legal reasoning behind the ruling, explores the structural relationship between the Shipping Act and the MRFTA, and evaluates the challenges of dual regulation in the shipping industry. Comparative analysis with international antitrust practices emphasize the need for clearer regulatory boundaries. The paper concludes by proposing legislative reforms to resolve conflicts between industry-specific and general competition laws, emphasizing regulatory consistency and legal certainty.
