최근 많은 기업들이 BYOD 정책을 적극적으로 채택하는 흐름이 확대되면서 다양한 문제가 나타나고 있다. 이에 2018년 5월 세도나 컨퍼런스는 BYOD에 관한 세도나 원칙을 발표한 바 있다. 우리나라 역시 다양한 분야에서 BYOD가 확산되고 있다는 점, 이에 따라 발생 가능한 문제 역시 유사하다는 점을 고려할 때 BYOD에 관한 세도나 원칙은 정리 및 검토의 가치가 있다. 이에 본고는 BYOD에 관한 지침의 필요성에 대해 간략히 정리하고, BYOD에 관한 세도나 원칙과 이에 관한 구체적인 내용을 소개하고 검토한 후 동 원칙에 대한 평가와 그 시사점에 관해 고민하였다. BYOD에 관한 세도나 원칙이 증거개시절차상 문제를 예방 및 해결하기에 충분하지는 않더라도 기본적인 역할은 할 수 있는 형태를 갖추었다고 판단된다. 하지만 다음과 같은 점에서 아쉬움이 남는다. 첫째, 주된 내용이 조직의 입장에서 문제를 예방하는 쪽으로 편중되어 있다. 둘째, 실무상 다툼의 여지가 많은 부분에 관한 내용이 누락되어 있다. 셋째, BYOD를 허용하지 않은 경우에 관한 문제 예방이나 해결에 관한 언급이 부족하다. 넷째, 증거개시절차상 보존의무에 관한 부분이 생략되었다. 향후 우리가 BYOD에 관한 세도나 원칙을 적극적으로 참조하여 우리 제도에서 활용하고자 할 경우, 추가로 고려해야 할 내용은 다음과 같다. 첫째, BYOD에 관한 문제의 예방 및 해결에 관해 주체별로 필요한 고려 요소를 구체적으로 제시할 필요가 있다. 둘째, BYOD에 관한 문제의 예방 및 해결을 위한 지침 마련 시 전자정보의 특성에 따른 문제의 예방 및 해결을 위한 고민이 전제되어야 한다. 셋째, 급변하는 기술 환경이 다양한 추가적 문제 내지 복합적 문제를 야기함으로 이에 관한 복합적 고려가 필요하다. 넷째, 적확한 규범의 마련과 이의 적정한 집행을 위해서는 기술적 이해가 선행되어야 한다.
Abstract
Recently, as many companies are actively adopting BYOD policy, various problems are appearing. And the Sedona Conference published the Sedona Principles on BYOD in May 2018. Considering the fact that BYOD is spreading in various fields in Korea and the problems that can occur are also similar, the Sedona principles on BYOD is worthy of review. In this article, the following contents were reviewed. first, the necessity of the BYOD guidelines. Second, the Sedona principles on BYOD and the specific details about them. Third, the evaluation of the Sedona principles and their implications. Although the Sedona principles on BYOD is not enough to prevent and solve the discovery problems, I think it can be the basis for this. However, the following points remain. First, the main content is focused on preventing problems from the standpoint of the organization. Second, there is a lack of content on the contentiousness in practice. Third, there is a lack of reference to preventing or solving the problem of not allowing BYOD. Fourth, the contents of preservation obligation on the discovery have been omitted. The following are additional considerations when using Sedona principles on BYOD in our system. First, it is necessary to give specific consideration to each subject. Second, in the preparation of BYOD guidelines, it is necessary to carry out a review for preventing and solving problems according to the characteristics of electronically stored information. Third, a complex review is necessary because the rapidly changing technology environment causes various additional problems. Fourth, the technical understanding needs to be preceded for the establishment of proper norms and enforcement.
