Abstract

One of the most widespread criticisms of utilitarianism is that it cannot take rights seriously enough. According to critics, utilitarianism denies the existence of fundamental moral rights , their roles in moral appraisal, and their overridingness. Owing to these features, utilitarianism has room for justifying the encroachment on moral rights in the name of morality if the encroachment is required to maximize the utility. Therefore, utilitarianism come up against criticism that it cannot take moral rights seriously and give secure foundation of moral rights. In response to these criticisms, utilitarianism has two approaches. One is Benthamite line, which tries to exclude the moral rights in moral discourse. The other is Millian line, which tries to accommodate the moral rights in utilitarian ethical system. Whereas Benthamite line rejects the existence of moral rights, their roles in moral appraisal, and their overridingness, Millian line accepts fundamental moral rights and their priority over individual utility, and attempts to show that utilitarianism takes the moral rights seriously enough. The Benthamite approach is faced with the problem of counterintuitiveness because it sometimes justifies the encroachment on moral rights. And it produces disutilities because it cannot accommodate the moral rights in the utilitarian ethical system. Therefore, Benthamite approach cannot breaks back of argument from moral rights. Millian approach accommodates the moral rights and their overridingness in moral evaluation at the sacrifice of consequentialism., which is the essential component of utilitarianism. As a result, Millian line cannot but convert to deontological right-based theory which is in opposition to utilitarianism. If Millian line reintroduces the priority of utility over the rights in order to avoid the conversion to deontology, the rights in Millian utilitarianism will be appendage rights. If Millian line is to keep in the theoretical boundary of utilitarianism, it cannot overcome the criticism that utilitarianism cannot take rights seriously. Therefore, Millian approach finds itself on the horns of a dilemma; one horn is to convert to deontological right-based theory and the other horn is revert to Benthamite approach. Both Benthamite and Millian line have difficulties in responding to argument from moral rights. Benthamite line imposes constraints on rights in favor of utility, whereas Millian line imposes constraints on utility in favor of rights. Two lines cannot overcome utility-right dilemma. Utilitarianism need to search for new strategy in order to defeat argument from moral rights.
