최근 들어 급속도로 추진되고 있는 ‘형사사법절차의 전자화’와 관련하여, 수사절차에 있어서 화상조사방법을 활용하는 방안이 지속적으로 논의되고 있다. 그리고 이러한 방법을 도입하자는 목소리는 코로나19 팬데믹 이후 더욱 강해진 상황이다. 현재 일반적인 피의자 신문이나 참고인 조사에 있어서 원격 화상조사방법을 사용할 수 있도록 하는 명문의 규정은 존재하지 않는 상황이고, 법무부는 추후 참고인 조사 등을 시작으로 원격 화상조사방법을 취할 것이라 예고하였으나 구체적인 방식이나 기준에 대하여 밝힌 바는 거의 없다. 형사절차의 전자화 추세 및 포스트 팬데믹 시대에 대한 대비라는 명분과 함께 해외 주요국의 움직임을 고려해 볼 때, 화상조사방법의 이점과 한계점, 해결해야 할 과제 등에 대한 논의를 바탕으로 화상조사방법을 수사단계에서 활용하는 방안에 대한 진지한 고민이 필요한 시점이라 생각한다. 다만 이를 적극적으로 활용하기 위한 여러 가지 선결과제들이 있다. 즉 효율적이면서도 신뢰가능한 조사방법으로서 실체적 진실 발견에 기여하기 위하여서는, ① 본인인증기술 및 네트워크 연결성과 보안성이 중심이 되는 기술적 요소, ② 조사 대상에 따른 허용범위의 차별화, ③ 범죄의 종류에 따른 허용범위의 차별화, ④ 피의자의 방어권 보장, ⑤ 조사 대상자의 의사, ⑥ 팬데믹 등 비상상황으로 인한 비대면성의 요청 정도 등을 세밀하게 분석하여 고려해야 할것이다. 그리고 위의 요소들을 종합적으로 고려하였을 때 비교적 안전한 영역부터 시범도입을 하여 차츰 적용범위를 확대해 가는, 단계적인 화상조사 시스템 구축 정책을 구상함이 바람직하다고 본다.
Abstract
In relation to ‘the digitalization of the criminal justice process’ which has been rapidly progressing lately, the use of remote interviews by video and audio link in the criminal investigation is continuously being discussed. After the COVID-19 pandemic, voices for introducing such a method have become stronger. The Ministry of Justice announced that it would adopt a remote video investigation method starting with investigations to persons other than the suspect in the future, but no specific method or standards were announced. Considering the trend toward the digitalization of the criminal justice process, the need to prepare for the post-pandemic era, and the current situation in other countries, I believe that it is time to seriously consider how to utilize the remote interview by video and audio link in the criminal investigation, based on the discussion on the advantages and limitations of the video investigation method and the problems to be solved. However, there are several prerequisites for the active use of the method. In other words, ① technical elements that take identity authentication technology, network connectivity and security as core contents, ② differentiation of the permissible range according to the subject of investigation, ③ differentiation of the permissible range according to the type of crime, ④ guaranteeing the suspect’s right to defend oneself, ⑤ the intention of the person being investigated, ⑥ the degree of untact requests due to emergency situations such as a pandemic, etc. must be carefully analyzed and considered. In the end, it seems necessary to establish a step-by-step remote video investigation system that gradually expands the scope of application by introducing a pilot from a relatively safe area when considering the above factors comprehensively.
