다크웹상 테러 선동행위의 형사법적 대응방안

초록

인터넷은 크게 3가지 영역으로 이루어져 있다. 표면웹, 딥웹, 그리고 다크웹이다. 다크웹은 딥웹의 일부로 의도적으로 은폐되어 있으며 통상적으로 접근할 수 없는 영역이다. 이러한 다크웹은 폐쇄성과 익명성이 보장되기 때문에 노출되기 싫어하는 범죄자들의 보물창고가 되고 있다. 최근 우리나라에서도 다크웹에 대한 논의가 개화되고 있는 상황에서 논문은 다크웹에서의 모든 범죄가 아닌 테러범죄 선동행위와 그 대응방안을 논의하였다. 다크웹의 익명성을 누리는 대다수의 사람들은 정치적 표현의 자유를 외치는 사람 뿐만 아니라 언론인 그리고 단지 혼자 있고 싶어 하는 우리들이다. 전체적인 규모에서 일부분에 불과한 사람들이 다크웹의 익명성을 활용해 범죄행위를 범할 뿐이다. 따라서 다크웹상 발생하는 범죄에 대한 형사정책적인 고려는 어떻게 하면 범죄자에 의한 인터넷(다크웹 포함) 사용을 방지하면서 자유민주적 가치질서에 내재된 표현의 자유를 보존할 수 있는 방안을 찾아야 하는 점에 중점을 두어야 할 것이다. 이러한 점을 근간으로 하여 본 연구에서는 다크웹상 테러 선동행위를 규제하기 위해 크게 3가지 방안을 검토하였다. 첫 번째는 규범적 구성요건으로 해석의 여지가 큰 테러범죄 선동죄의 구성요건을 구체적 위험범으로 해석하는 방안과 그 기수시기를 선동행위를 불특정 다수인이 인식 가능한 상태로 두는 것으로 해석하는 방안을 제시하였다. 두 번째는 다크웹의 익명성을 극복하기 위한 제도적 정비방안과 신종 수사기법 도입방안을 제시하였다. 다만 본 고에서 제안한 NIT, MEMEX 같은 수사기법은 감시사회의 도래와 개인정보 자기결정권을 침해할 우려가 있으므로 제한된

Abstract

The Internet consists of three main areas. It is the surface web, the deep web, and dark Dark web is an area that is intentionally concealed as part of the deep web and is usually inaccessible. The dark web is a treasure trove of criminals who don't want to be exposed because it is guaranteed to be closed and anonymous. With the discussion on the dark web also being enlightened in Korea recently, the paper discussed the instigation of terrorist crimes and their countermeasures, not all crimes on the dark web. The majority of people who enjoy the anonymity of the Dark Web are journalists and people who just want to be alone, as well as those who cry for freedom of political expression. Only a small portion of the overall scale uses the anonymity of the Dark Web to commit crimes. Therefore, criminal policy considerations for crimes occurring on the dark Web should focus on how to prevent the use of the Internet (including the Dark Web) by criminals while preserving the freedom of expression inherent in the liberal democratic value order. Based on this, the study considered three major measures to regulate acts of incitement to terrorism on the dark web. The first suggested a method of interpreting the elements of incitement to terrorist crimes as specific risk offenders since they are normative components with great room for interpretation, and a method of interpreting demagogic behavior as leaving it recognizable by an unspecified person at the time. The second suggested institutional readjustment measures to overcome the anonymity of the dark web and the introduction of new investigative techniques. Finally, efforts to self-purify the private sector necessary to overcome the liquidity of the dark web were reviewed and the establishment of a cooperative system with the investigative agencies were reviewed.
