중국에서 수습변호사 제도는 1979년부터 확립되기 시작했지만 현대적 의미에서의 수습변호사제도는 1996년에 출현하였다. 2005년까지 중국에서 변호사수습업무는 사법행정기관에서 주관하고 있었고 변호사의 수습은 형식에 그치고 있었다. 그러나 2007년부터 변호사협회가 변호사수습업무를 주관하면서 근본적인 변화가 발생하였다. 중화전국율사협회는 2007년부터 본격적으로 수습변호사 제도에 대한 대대적인 개혁과 정비를 하였다. 수습관련 규칙과 제도를 정비하고 수습의 구체적인 내용과 비전을 명확하게 제시하고 있다. 이 논문에서는 절차적 규정과 실체적 규정 두 부분으로 나누어 중국의 현행 수습변호사 제도에 대한 소개를 하고 있다. 그리고 평가부분에서는 지금까지 중국의 수습변호사 제도에 존재하여 온 문제점을 제시하고 현행 수습변호사 제도의 구체적인 의의와 향후 과제를 제시하고 있다.
Abstract
The probationary lawyer system in China was established in 1979, but its morerecent version appeared in 1996. Up til 2005 the probationary lawyer system in China was supervised by judiciary authorities and at conventional level. However there were fundamental changes after the Chinese Bar Association took control over the probationary lawyer system in 2007. The Chinese Bar Association introduced an inovative regulation and organization of probationary lawyer system. This includes of engineering probation related law and system, and making clear statements of its specific contents and vision.This paper divides into two parts, procedural and substantial regulation, and introduces each part of current probationary lawyer system in China. And then it presents the curent prolonged problem in probationary lawyer system, and also concrete meaning and assignments for future tasks.
