도로는 국가의 주요 기반시설 중 하나로서 교통 및 물류 시스템에 필수적인 시설인 한편, 그 건설에서 이용, 유지, 관리에 이르기까지 전 과정에 걸쳐 이산화탄소 등의 오염물질을 발생시키는 주요 환경오염원으로 지적되어왔다는 점에서 녹색도로로의 전환은 매우 시급한 과제라 할 수 있다. 녹색성장 하에서 녹색도로는 “자원의 절약 및 효율적 이용을 통해 온실가스 감축 등 환경오염의 발생을 최소화하는 도로”로 정의할 수 있다. 현실적으로 도로는 건설공사단계부터 공사완료 후 운영과정에 이르기까지 각 단계별로 생태계 및 인간의 건강에 대해 매우 다양한 영향을 미친다. 또한 도로와 관련한 에너지 소비와 오염물질 배출도 도로의 설계에서 운영에 이르는 전 기간에 발생한다. 그러나 그 건설계획과 설계, 운영 및 관리와 관련하여서는 기반시설인 “도로” 보다는 “교통” 차원에서의 논의가 주된 쟁점임을 고려하여 이 논문에서는 “도로”를 구성하는 원재료와 관련하여 순환골재 등 재활용 재료를 사용함으로써 환경영향을 저감하고 자원순환을 촉진하는 범주로 한정하여 녹색도로를 고찰하였다. 건설폐기물의 재활용촉진에 관한 법률은 이러한 측면에서 녹색도로를 위한 근거법으로 평가할 수 있다. 이 법은 도로공사용 재활용 원재료로서 순환골재를 규정하고 순환골재 의무사용 도로 및 그 사용의무에 관한 규정을 두고 있다. 순환골재의 품질에 대한 공학적 평가도 긍정적으로 이루어지고 있다. 그러나 현실적으로 순환골재가 적극적으로 활용되고 있지 못한 실정이다. 이는 여러 가지 문제가 있을 수 있으나 무엇보다도 순환 자원의 품질에 대한 신뢰 부족과 순환 자원의 활용을 위한 능동적 제도의 한계에 주요 원인이 있다고 평가된다. 이러한 문제를 해결하기 위해 (1) 오염에 대한 규제에서, 생태적 효율성의 향상을 위한 정책적 전환과 법제도적 보완 (2) 녹색도로기술에 관한 연구 및 개발을 위한 장기적 관점에서의 공적 지원 (3) 녹색도로기술 상품의 생산 및 판매를 촉진하기 위한 제도적 지원 (4) 협력절차의 도입 (5) 그린세제와 그린예산의 도입 등과 같은 방향으로 법제도적 보완이 이루어져야 할 것이다.
Abstract
It is now widely recognized that Climate change is caused by Greenhouse gas. In spite of the increasing environmental pressures arising from economic growth, it is only possible through economic growth that nations of the Asia-Pacific region can reduce poverty and improve the national welfare. The new paradigm of Green Growth seeks to harmonise economic growth with environmental sustainability. Since a road is one of the major infrastructure in the nation, Greenroad is one of the essential constituents in Green Growth. Greenroad could be defined as a road which minimize the ecological impact by reduction the use of natural resources and enhancing the efficient usage of them. Our economy largely depends on transportation infrastructure, including roads. However a road have an impact on our environment throughout all phases of it’s life cycle. This paper explores how a legal system can support a recycling for the sustainable road construction. A law on recycling for construction waste has a number of recommendations to encourage recycling for sustainable road construction. Also several technical research papers have shown that recycled materials have a sufficient quality for sustainable pavements. In spite of these legal and technical support for Greenroad, recycled materials have not been prevailingly used in practice. So, our legal system and individual laws need to amend for supporting active use of recycled materials. The Greenroad policy tools could be included (1) development policies and laws, which focus on improving ecological efficiency of growth (2) providing fund and technical support for the sustainable infrastructure, (3) greening the market and the business, (4) developing the participatory process, (5) doing the green tax and budget reform.
