일반적인 해상사고의 경우 그 원인이 불가항력적인 요인 또는 선박의 결함 등으로 발생하는경우가 많았으나 최근 해상사고의 경우 컨테이너 화물의 중량과 관련된 사고가 많으며 이러한사고는 거대한 비용 손해를 발생시키고 있다. 이에 컨테이너 화물의 중량 초과에 따라 발생하는 해상사고의 사례를 살펴봄으로써 그 원인과 함께 이를 해결하기 위한 방안을 제시하고자하였다. 컨테이너 화물의 중량 초과로 인한 문제를 해결하기 위한 대표적인 방안으로 국제해상인명안전협약(SOLAS)에 컨테이너 화물 총중량 검증제도(VGM)를 도입, 의무화하였으며, 각국은 이에 대응하기 위한 규정의 신설 및 도입과 함께 제도를 시행하기 위한 계측소 설치, 검사 비용에 대한 부담 등을 논의하였다. 본 연구에서는 최근 발생한 주요 해상 사고 중 컨테이너 총중량 계측 오류에 따른 사례와 함께 이를 해결하기 위해 도입된 VGM 제도의 장단점 등을 검토함으로써 본 제도 도입 시, 거래 당사자에게 발생할 수 있는 문제점을 분석하고 시사점을 제시하였다.
Abstract
Purpose : The purpose of this study is to suggest maritime accidents and solutions due to excessive container cargo weight. Research design, data, methodology : The paper uses the VGM system established by SOLAS along with cases of accidents caused by container cargoes of each shipping company to examine possible problems and countermeasures for each party. Also analyze various cases of overweight accidents in maritime transport. Results : The result suggests that in the case of maritime accidents due to the weight of container cargo, it is possible to achieve cargo and ship safety by understanding the measured cargo information in advance through the introduction of the VGM system. Conclusions : This result shows that it affects the airworthiness of containers and ships, the VGM system, etc. must be implemented to protect each transaction party from overweight, false and incompletely described cargo
